FINDING AND DETERMINING THE PUBLIC INTEREST
AND NECESSITY REQUIRE THE PROPOSED PROJECT,
THAT THE PROPOSED PROJECT IS PLANNED OR
LOCATED IN THE MANNER MOST COMPATIBLE WITH
THE GREATEST PUBLIC GOOD AND THE LEAST
PUBLIC INJURY, THAT THE PROPERTY IS NECESSARY
FOR THE PROPOSED PROJECT, AND THAT AN OFFER
OF JUST COMPENSATION HAS BEEN MADE

WHEREAS, the City of Alameda, a charter city, is authorized to
provide for the public health, safety and welfare, and to provide
for recreational, cultural, social, residential, and other
benefits; and
WHEREAS; the City is authorized to acquire property by eminent
domain for the purpose of providing said services pursuant to the
Eminent Domain Law, including Code of Civil Procedure sections
1245.210 et. seq., and Government Code section 37350.5; and
WHEREAS; the acquisition of property is necessary in order to
provide a possible library site and interim housing, as well as
other public uses for the City; and
WHEREAS; the City noticed and scheduled a public hearing with
regard to considering and adopting a resolution of necessity
pursuant to Code of Civil Procedure sections 1245.210 et seq.,
relating to the acquisition of certain property by eminent domain
for public use; and
WHEREAS; the City has heard and considered information relating to
the proposed project, to its public use, and to the public
interest, necessity, and convenience;
NOW, THEREFORE, BE IT RESOLVED by the City of Alameda, acting by
and through its Mayor and City Council, as follows:
1. That the governing body finds and determines each of the
following:

(1) The public interest and necessity require the>:
proposed project.

(2) The proposed project is planned or located in thezi
manner that will be most compatible with the greatest public
good and the least private injury.
(3) The property described in the resolution is
necessary for the proposed project.
iat the offer required by Section 7267.2 of the
Government Code has been made to the owner or owners of
record.
2. That the proposed project is a possible library" site and
interim housing uses, as well as other public uses.
3. That the acquisition is permitted by law.
4. That the property to be acquired is fee title to the property
located at the address generally known as 2310 Lincoln Avenue,
Alameda, A.P. Nos. 71-202-35-1 & 4;
5. That City legal counsel, City Manager, and staff are
authorized and directed to take such steps and actions, and to file
such legal proceedings, as may be necessary to acquire the property
and to obtain an order of immediate possession.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the 16th day of
January, 1990, by the following vote to wit:

President Corica 5,
