Resolution 11931CITY OF ALAMEDA RESOLUTION NO. 11931 SUPPORTING AB 2023 CONCERNING OPERATION OF COIN-OPERATED VENDING MACHINES CONTAINING HARMFUL (SEXUALLY EXPLICIT) MATERIAL WHEREAS, current law prohibits displaying in coin- operated vending machines harmful matter displaying to the public view photographs or pictorial representations of the commission of specified sexual acts; and WHEREAS, AB 2023 would establish a new crime category by stipulating that the sale of harmful material (as defined in Section 313 of the Penal Code) through vending machines is prohibited in public places unless the vending machines are supervised by an adult or are located in an area where there is restricted access to minors; and and WHEREAS, violation of AB 2023 would be a misdemeanor; WHEREAS, the City of Alameda and the citizens of this community believe strongly in protecting our youth from the detrimental effects of harmful material. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that said Council hereby supports AB 2023 and requests that the members of the State Legislature vote for its passage. BE IT FURTHER RESOLVED that the City Clerk is hereby directed to send a copy of this resolution to State Senator Nicholas C. Petris; Assemblyman Elihu Harris; and to sponsoring legislators: Assembly Members Ferguson, Allen, Bader, Bradley, Chacon, Condit, Eaves, Filante, Frazee, Hansen, Harvey, Johnson, La Follette, Leslie, Nolan, Pringle, Seastrand, Statham, Woodruff, and Wyman, as well as Co-authors Senators Doolittle, Cecil Green, Kopp, Nielsen and Russell.
