Resolution 11938CITY OF ALAMEDA RESOLUTION NO. 11938 AUTHORIZING THE EMERGENCY REPAIR OF SANITARY SEWER AND MANHOLE AT WALNUT STREET AND PACIFIC AVENUE PURSUANT TO SECTION 3 -15 OF THE CITY CHARTER AND APPROPRIATING $33,223.15 FROM THE SEWER SERVICE FUND WHEREAS, on February 7, 1990, the pavement at the intersection of Walnut Street and Pacific Avenue collapsed; and WHEREAS, the hole in the street was approximately 8 feet by 10 feet across and several feet deep; and WHEREAS, a manhole had dropped down: WHEREAS, the manhole broke and blocked the sanitary sewer main; and WHEREAS, emergency repairs were needed; and WHEREAS, the State Water Resources Control Board requires that corrective action be taken when at least 1,000 gallons of sewage spill or a fine will be imposed; and WHEREAS, Section 3 -15 of the City Charter allows the City Council, by a four - fifths vote, to authorize emergency repair work to be done without going out to bid; and WHEREAS, $33,223.15 is available and must be appropriated from the Sanitary Sewer Fund to cover the costs of the necessary repairs. NOW, THEREFORE, BE IT RESOLVED BY the City Council of the City of Alameda that the emergency repairs for the sanitary sewer and manhole at Walnut Street and Pacific Avenue are hereby authorized under Section 3 -15 of the City Charter without going to bid BE IT FURTHER RESOLVED that $33,223.15 be appropriated from the Sanitary Sewer Fund to cover the cost of the necessary repairs. * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adoted and passed by the Council of the City of Alameda in regular meeting assembled on the 6th day of March , 1990 by the following vote to wit: AYES: NOES: Councilmembers Arnerich, Camicia, Thomas, Withrow and President Corica - 5.
