Resolution 11943CITY OF ALAMEDA RESOLUTION NO. 11943 ORDERING THE VACATION OF CERTAIN RIGHT-OF-WAY WITHIN LOT 2, PARCEL MAP NO. 4949. (ALAMEDA MARINA VILLAGE AT ATLANTIC AVENUE) - WHEREAS, the City Council of the City of Alameda authorized the consent to the acceptance of Deeds and Grants of Real Property or Easements thereon, by Resolution No. 5328, adopted May 15, 1956, in order to construct an "industrial highway." WHEREAS, an easement was granted by the Alaska Packer's Association to the City for a right-of way which lies within Lot 2, Parcel Map No. 4949; and WHEREAS, this easement was recorded on June 27, 1961 (Recorders Series No. AS81214; and WHEREAS, Alameda Marina Village has requested that the City relinquish its right over the subject right-of-way; and WHEREAS, a proposed industrial highway has been replaced by an extension of Atlantic Avenue constructed as part of the Marina Village development; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Alameda that: (1) The industrial highway for which the right-of-way was acquired has been relocated. (2) It is hereby found and determined that the subject right-of-way has never been utilized for any municipal purpose and it is not proposed that it ever will. (3) The subject parcel is isolated and removed from any existing roadway or easement. (4) There will be no financial impact to the City as a result of vacating the subject right of way. BE IT FURTHER RESOLVED that it is hereby ordered that the right-of-way described in Exhibit A attached hereto is vacated pursuant to the provision Chapter 4, Part 3, Division 9 of the California Streets and Highways Code, particularly Section 8333 thereof. CD BE IT FURTHER RESOLVED that the City Clerk shall cause certified copies of this order, attested under seal, to be recorded in the County Recorders Office and from and after the date this resolution is recorded, said portions of the public access/right- of-way no longer shall constitute easements. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the 3rd day of April , 1990, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Thomas, Withrow and President Corica - 5.
