Resolution 11963CITY OF ALAMEDA RESOLUTION NO. 11963 RESOLUTION OF INTENTION TO LEVY AN ANNUAL ASSESSMENT ON THE ALAMEDA BUSINESS IMPROVEMENT AREA OF THE CITY OF ALAMEDA FOR FISCAL YEAR 1990 -91 WHEREAS, Chapter 4 of Title XIII of the Alameda Municipal Code establishes the Alameda Business Improvement Area of the City of Alameda (hereinafter Area); and WHEREAS, the City Council of the City of Alameda desires to continue said Area in Fiscal Year 1990 -91 for the purposes set forth in Section 13 -413 of the Alameda Municipal Code; and WHEREAS an agreement between the City of Alameda (hereinafter "City ") and the Alameda Main Street Project (hereinafter "AMSP ") designated AMSP to administer FY 1989 -90 BIA funds and to work with the Park Street Business Association (hereinafter "PSBA ") and the West Alameda Business Association (hereinafter "WABA ") to develop a program and budget for FY 1990- 91; and WHEREAS, AMSP, on behalf of PSBA and WABA, has filed a report with the City Clerk describing the surplus or deficit revenues to be carried over from FY 1989 -90 and describing the improvements and activities, estimated costs and methods and basis for levying the assessment for FY 1990 -91; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Alameda that the improvements and activities of the Area include the general promotion of business activities in the Area, the promotion of public events which are to take place on or in public places in the Area, the decoration of any public place in the Area, the furnishing of music on any public place in the Area, and the acquisition, construction or maintenance of parking facilities for the benefit of the Area; and BE IT FURTHER RESOLVED that the Area comprises all of the Park Street Business Area, included by reference on the map and list of inclusive addresses included in this Resolution as Exhibit A and C, respectively; and all of the Webster Street Business Area included by reference on the map and list of inclusive addresses included in this Resolution as Exhibit B and C, respectively; and BE IT FURTHER RESOLVED that the AMSP is hereby designated as the Interim BIA Advisory Body for 1990 and that the report of the Interim BIA Advisory Body is hereby accepted; and that the City Council hereby designates PSBA and WABA as the BIA Advisory Body for 1991; and BE IT FURTHER RESOLVED that a report has been filed with the City Clerk describing the surplus or deficit revenues to be carried over from FY 1989 -90 and describing the improvements and activities, estimated costs and methods and basis for levying the assessment for FY 1990 -91; and BE IT FURTHER RESOLVED that the City Council hereby declares its intention to levy and collect assessments within the Alameda Parking and Business Improvement Area for FY 1990 -91; and BE IT FURTHER RESOLVED that the City Council hereby sets a public hearing on the levy of the proposed assessment before the City Council at its regular scheduled meeting of June 5, 1990, at which time written and oral protests may be made in conformance with Streets and Highways Code Section 36524 and 36525; and BE IT FURTHER RESOLVED that the City Clerk is hereby directed to advertise said public hearing by causing this Resolution of Intention to be published once in a newspaper of general circulation in the City not less than seven days before the public hearing.
