DECLARING SOURCES OF INFILTRATION AND INFLOW FROM STORM
WATER ON PRIVATE PROPERTY LOCATED IN THE SANITARY SEWER
BASIN 94G TO BE A PUBLIC NUISANCE; ORDERING THE ABATEMENT
OF SAID NUISANCES, AND AUTHORIZING THE CITY ENGINEER TO
TAKE THE NECESSARY ACTION TO CORRECT SAME
WHEREAS, Title VI, Chapter 4, of the Alameda Municipal
Code requires that owners of property, where infiltration and
inflow problems are in existence, to remove or correct such
improper sewer connections, and authorizes the City Council to
declare such properties a public nuisance; and
WHEREAS, a list of properties within sewer basin 94G have
been identified as having damaged or improper sewer connections
that allow storm water to inflow and infiltrate into the sewer
system; and
WHEREAS, a public hearing has been held on November 20,
1990, to allow the owners of the identified properties to appeal
the decision of the City Council, prior to enforcing correction and
that this list of identified properties has been amended, if
necessary, according to the findings of the Council at that
hearing.
NOW, THEREFORE, BE IT RESOLVED that, the Alameda City
Council declares each property listed in Appendix A, as amended, 4
to be a public nuisance and orders the City Engineer to abate, or
cause to be abated, such public nuisance, and that the City
Engineer, his assistants, employees, contracting agents or othermic_
representatives are hereby authorized to enter upon privatez:
property for that purpose in compliance with applicable laws.
