ORDERING THE VACATION OF STORM DRAIN EASEMENT WITHIN LOT
84, TRACT 6198 (NEIGHBORHOOD 'D', VILLAGE V).
WHEREAS, the City Council of the City of Alameda approved
the final map for Tract 6198 on March 20, 1990; and
WHEREAS, on September 4, 1990, an easement was recorded
(Alameda County Records Series #90- 237241) dedicating a 10 -inch
wide storm drain easement to the City, which easement was located
in Lot 84 adjacent to the common line of Lots 83 and 84; and
WHEREAS, on September 4, 1990, the common line of Lots
83 and 84 was adjusted; and
WHEREAS, the subject easement has never been used for the
purpose intended; and
WHEREAS, a new 10 -inch wide storm drain easement was
dedicated to the City in Lot 84 adjacent to the adjusted common
line of Lots 83 and 84 (Alameda County Records Series #90- 317614);
and
WHEREAS, there are no existing improvements within the
subject storm drain; and
WHEREAS, there is no financial impact to the City of
Alameda as a result of vacating the subject easement; and
WHEREAS, a legal description describing the easement,
proposed to be vacated, together with plat map, is attached hereto
as Exhibit A & B.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City°
of Alameda that:
(1) It is hereby found and determined that the easement
described in Exhibit A is unnecessary for present or prospective
public use and has been superseded by relocation, and there are no
public facilities located thereon.
(2) It is hereby ordered that the storm drain easement
located within Lot 84, Tract 6198, as described in the attached
legal description and plat map (Exhibits A & B), is hereby vacated
in conformance with the provisions of Chapter 4, Part 3, Division
9 of the Streets and Highway Code, and particularly Section
8.333(c) thereof.

PARTICULARLY DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHERLY CORNER OF SAID LOT 84, SAID CORNER
