AMENDING THE TIME FOR COMPLIANCE WITH
AFFORDABLE HOUSING UNIT AND FEE REQUIREMENTS
FOR TITLE XX OF THE ALAMEDA MUNICIPAL CODE
WHEREAS, the City Council previously adopted Resolution No.
11899 establishing the Affordable Housing Unit and Fee Requirements
for Title XX of the Alameda Municipal Code; and
WHEREAS, the City Council desires to amend the time for
compliance in accordance with the revisions to Title XX of the
Alameda Municipal Code; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Alameda that in accordance with Title XX of the Alameda
Municipal Code the paragraphs entitled Construction of Affordable
Housing Units and Payment of In -Lieu Fees of Resolution No. 11899
are hereby amended to read as follows:
Affordable Unit Requirements
Construction of Affordable Housing Units: Except as otherwise
provided in this Resolution, a developer of a commercial or
industrial development shall construct affordable housing units.
Such units shall be constructed and complete prior to the issuance
of any Temporary Certificate of Occupancy for the commercial or
industrial development unless the applicant deposits in an escrow
satisfactory to the City Attorney funds sufficient to cover the
completion of the affordable housing units within one year from the
date of the issuance of any Temporary Certificate of Occupancy .
Housing Fee Requirement
Payment of In -Lieu Fee: As an alternative to providing
affordable Housing Units, an Affordable Housing Fee shall be paid
prior to the issuance of any Temporary Certificate of Occupancy.
No issuance of a Temporary Certificate of Occupancy shall occur
unless said Fee has been paid to the City into the separate and
special account established for Affordable Housing Fees.
NOW, THEREFORE, BE IT FURTHER RESOLVED by the Council of the
City of Alameda that this resolution shall be effective when the
proposed ordinance entitled: AMENDING THE ALAMEDA MUNICIPAL CODE
BY AMENDING SECTIONS 20 -141, 20 -142, 20 -161, AND 20 -171 OF ARTICLE
4, TITLE XX THERETO PERTAINING TO TIMING OF COMPLIANCE FOR
AFFORDABLE HOUSING REQUIREMENTS FOR NEW AND EXPANDED DEVELOPMENT
AND THE PROCEDURES THEREFOR is effective.

I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in adjourned regular meeting assembled on the
seventh day of March, 1991, by the following vote to wit:
AYES: Councilmembers Thomas, Withrow, and
Acting President Arnerich - 3.
NOES: None.
ABSENT: Councilmember Camicia and President Corica - 2.
ABSTENTIONS: None.
