Resolution 12096CITY OF ALAMEDA RESOLUTION NO. 12096 DESIGNATING THE TRANSPORTATION PLAN COMMISSION AS THE CONGESTION MANAGEMENT AGENCY AND AUTHORIZING THE MAYOR TO EXECUTE THE JOINT POWERS AGREEMENT REGARDING THE CONGESTION MANAGEMENT PROGRAM WHEREAS, the voters approved an $18.5 billion transportation funding program known as Proposition 111 and 108 at the June 1990 election; and WHEREAS, this voter approval included the requirement that each urban county in California prepare, update and administer a Congestion Management Program; and WHEREAS, for highway and rail projects to be eligible for state funding, such projects must be included in a Congestion Management Program; and WHEREAS, if a city or county is found not to conform to the Congestion Management Program, its new gas tax revenues pursuant to Proposition 111 will be withheld; and WHEREAS, an agency must be designated to administer the Congestion Management Program by a majority of the cities representing a majority of the population and the Board of Supervisors; and WHEREAS, the Alameda County Mayor's Conference has made a recommendation at its February 13, 1991 meeting that the existing Transportation Plan Commission be so designated; and WHEREAS, a Joint Powers Agreement is necessary to define the Transportation Plan Commission's role as the Congestion Management Agency. NOW, THEREFORE, BE IT RESOLVED that the City of Alameda does designate the Congestion Management Agency for Alameda County composed as follows: o one vote for each Alameda County city for every 100,000 population or fraction thereof; o two voting representatives of the Alameda County Board of Supervisors; o one voting representative each for AC Transit, BART, the Livermore Amador Valley Transit District, and Union City Transit; and o one non - voting representative each of the California Department of Transportation (District 4), the Metropolitan Transportation Commission and the Bay Area Air Quality Management District. BE IT FURTHER RESOLVED that the Mayor of the City Council is authorized to execute the Joint Powers Agreement, dated February 20, 1991, which defines the roles, purpose, objectives, responsibilities, powers, and duties of the Congestion Management Agency. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the sixteenth of April, 1991, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Lucas, Roth and President Withrow - 5.
