AUTHORIZING ADVANCE DISABILITY PENSION PAYMENTS
IN CERTAIN SPECIFIED CASES
WHEREAS, the City of Alameda Safety Pension System was
transferred to the PERS Safety Retirement System effective January
1, 1991; and
WHEREAS, Labor Code Section 4850.3 allows an applicant
with a work related disability to request pension payment advances
for disability pensions;
WHEREAS, the procedure set for in Labor Code Section
4850.3, as amended shall apply in making determinations for
Disability Pension payments for public safety retirees. Labor Code
Section 4850.3 states as follow:
"Labor Code Section 4850.3. Advance disability pension
payments. A City...which is a member of the Public
Employees' Retirement System or subject to the County
Employees Retirement Law of 1937 may make advanced
disability pension payments to any local safety officer
who has qualified for benefits under Section 4850 and is
approved for a disability allowance. The payments shall
be no less than 50 percent of the estimated highest
average annual compensation earnable by the local safety
officer during the three consecutive years of employment
immediately preceding the effective date of his or her
disability retirement....Advanced disability pension
payments shall not be considered a salary under this or
any other provision of law. All advanced disability
pension payments made by a local agency with membership
in the Public Employees' Retirement System shall be
reimbursed by the Public Employees' Retirement System
pursuant to Section 21293.1 of the Government Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Alameda does hereby authorize pension payment advances
on disability retirements as set forth in Labor Code Section
4850.3, as amended.
I, the undersigned, hereby certify that the foregoing Resolution
was duly and regularly adopted and passed by the Council of the
City of Alameda in regular meeting assembled on the eighteenth of
June, 1991, by the following vote to wit:
AYES: Councilmembers Arnerich, Camicia, Lucas, Roth
and President Withrow - 5.
NOES: None.
ABSENT: None.
ABSTENTIONS: None.
