Resolution 12133CITY OF ALAMEDA RESOLUTION NO. 12133 AUTHORIZING EXECUTION OF SETTLEMENT AGREEMENT, DISSOLUTION OF THE ALAMEDA COUNTY TRAINING AND EMPLOYMENT BOARD /ASSOCIATED COMMUNITY ACTION PROGRAM AS A JOINT POWERS AUTHORITY, AND EXECUTION OF NEW ASSOCIATED COMMUNITY ACTION PROGRAM JOINT POWERS AUTHORITY WHEREAS, on September 1, 1983, the City of Alameda joined a Joint Powers Agreement dated April 22, 1975, establishing the Alameda County Training and Employment Board /Associated Community Action Program ( "ACTEB /ACAP "); and WHEREAS, since its formation, ACTEB /ACAP has administered the federal Job Training Partnership Act ( "JTPA ") and Community Action Program ( "CAP ") funds, and has been the State - designated Service Delivery Area ( "SDA ") administrator of JTPA funds; and WHEREAS, the City of Berkeley withdrew from ACTEB as of April 6, 1990, after refusing to approve the Job Training Plan submitted by ACTEB /ACAP, therefore, causing the State to designate Alameda County as the SDA; and WHEREAS, ACTEB, as presently constituted, consists of 13 units of local government organized as a consortium: Alameda County, and the cities of Alameda, Albany, Dublin, Emeryville, Fremont, Hayward, Livermore, Newark, Piedmont, Pleasanton, San Leandro, and Union City; and WHEREAS, it is now necessary for the member cities to close out all JTPA business, dissolve ACTEB /ACAP and form a new Joint Powers Authority to administer CAP funds, which were not affected by the State's action. WHEREAS, Alameda will continue to have a representative on the ACAP Governing Board. NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Alameda authorizes the Mayor to execute the Settlement Agreement between the Department of Labor and ACTEB, attached hereto as Exhibit A; and BE IT FURTHER RESOLVED that the Council of the City of Alameda authorizes the dissolution of the ACTEB Joint Powers Authority. BE IT FURTHER RESOLVED that the Council of the City of Alameda authorizes the retention of ACAP as a separate JPA and authorizes execution of an amended new Joint Powers Authority Agreement. BE IT FURTHER RESOLVED that the Council of the City of Alameda approves and authorizes the withdrawal of the City of Alameda from ACTEB, a non -Joint Powers Luthority. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly adopted and passed by the Council of the City of Alameda in regular meeting assembled on the sixteenth of July, 1991, by the following vote to wit: AYES: Councilmembers Arnerich, Camicia, Lucas, Roth and President Withrow - 5.
