Resolution 01344RESOLUTION NO. 1344. IN THE MATTER. 07 ACQUISITION AND IMPROVEMENT DISTRICT NO. 2 07 THE LITT UT ALAMEDA RESOLUTION 2 INTENTION No. 90, N.S. RESOLVED AND DETERMINED, by the Council of the Cilty of Alameda that public interest and neceesity require the improvements hereinafter set forth and it is the intention of said council to order the following described work to be done and improvements to be made on-thooe certain pellic ways in said city, described as follows, to-wit: That Duane Vista Avenue, from the eastern line of eebster Street to the western line of park Street, be scaritied, regraded, and have e wsterbound macadam base constructed thereon; after which an asphaltic concrete pavement shall be constructed on said base of the width and thickness and withiu the limit shown on the plans and specifications hereinafter referred to; All of said work and improvements shall be done in accordance with the plane, profiles, detail drawings and epeoifications therefor whieh have been approved by said council and are now on file in the office of the clerk thereof, reference to which is hereby made far the eetimated cost of the imoravement (inclusive of incidental expenses end coats of the proceeding), for a full end detailed description and location of said proposed improvements and of the grades to whioh said improvements are to be conatructed. The notice ef all persons affected is directed to the grades for the proposed improvement and to the provisions of the "Acquieitien and Improvement Act of 1925" relating to gredes. The district of the lands to be benefited by said proposed improvement is hereby described as follows: All the parcels or tracts of land situate, lying and being within the corporate limits of the City of Alameda, according to the map thereof approved by the council and now on file with the clerk. Excepting from said district all public waye and all land belonging to the United 2tates and the State of California. 17.n the judgment ef the city council, there will be no varying benefits to be derived by the different parcels of land lying withinothe asseeameut district, as a consequence the district has not been divided into zones. Reference is hereby made to the plat or map entitled "Map of Acquisition and Improvement District No. 2 of the City of Alameda", approved by this city council ebruery 19th, 1929, and now on file in the office of the clerk thereof, whereon there is indicated by a boundary line, the extent of the territory to be included in said proposed assessment district; provided, that all public ways are not included in said district, said street e and public ways being now in use in thd performance of public functions as public highways. Bends will be issued for the expenses of the work and improvements herein proposed to be done to the total amount of the expense thereof, said bond to bear interest at the rate of six (6) per cent per annum, payable semi-annually, the first interest payment to be made on the second day of January or the second day of July (whichever mouth first succeeds the date of the bonds) next succeeding one year after the date of such bonds. The aggregate principal of oll bonds issued under this proceeding shall be paid and discharged within twenty years after the date of isseance, end approximately one-twentieth part of such eggregetd principal shall be payable annually, as hereinafter provided, all in gold coin, it being the determination of this council that the first payment on the aggregate principal of the bonds issued will be made one year after the issuance thereof. A. special fund for the payment of said bonds will be constituted by the levy of special assessment taxes upon the lands within the assessment distriot, in accordance with the provisions of said act, according to the assessed value of said lands, exclusive of improvements thereon, except as otherwise provided in said act. The proceedings far the work and improvements herein mentioned, including the bonds to provide for the expenses thereof, shall be taken under and in pursuance of the provisions of the "Acquisition:. and Improvement Act of 1925". 7Ietiee is hereby given that Tuesday, march 19th, 1929, at the hour of 5.00 o'clock 2.12. of said day, in the chamber of this city council, is the time and place when and where any end all persons having any objections to the proposed work and improvements or to the proposed grades to which the improvements are to be conotructed, or to the extent of the Eieeeesment dietrict, or to any or all of the foregoing, may appear before this city council and be heard, said time being not less than eighteen nor more than sixty days from the date of the adoption ef this resolution. The clerk of this council shall cause this Reso1utin f Intention to be published by two insertions in the Alameda Times-star, a newspaper of general circulation published and circulated in the City of Alameda, which newspaper is hereby designated as the newspaper or making the publication of this Resolution of Intention end all other publications in or incident to the proceedings hereof. The City Council of the City of Alameda hereby appoints Burnett Hamilton "Superintendent of Work", whose duty it shall be to perform the services prescribed or indicated for him in said Act, and to have general actual supervision of the improvements constructed, without compensation, The "superintendent of 71ork" shall cause to he conspicuously posted along the line of said contemplated work and improvements, notices of the adoption of this resolution, in the time, form and manner required by said Act. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the council of the City of Alunede in regular meeting assembled on the 19th day of February, 1929, by the following vote, to wit: Otis, (5).
