Resolution 01434RESOIIJTION NO. 1434 IN TID I/LATTER 01' ACZTJISITION AND II,U,R0VI3aNT DISTRICT NC. 2 OF VIE CITY OF ALAIMDA RESOLUTION AND ORDER FOR TIE ISSUANCE OF BONDS WHEREAS, on February 19, 1929, this City Council adopted its Resolution of Intention to order certain work to be done and improvements to be made in the above-entltledCmatter, under and pursuant to the pro- visions of the Acquisition and Improvement Act of 1925, reference being hereby expressly: made to said Resolution of Intention for furtler partiou- lars, and c';HEREAS, said work has been done, and declaration of completion filed and a hearing held thereon after notice, all in accordance with the provisions of sections 23 and 24 of said act; and said work having been accepted by this ccuncil now therefore, it is hereby RESOLVED AND ORDERED that upon the expiration of twenty days from the date of said final order of acceptance, the clerk of this council shall transmit to the treasurer an attested copy of said final order, upon the receipt of which the treasurer shall proceed to issue bonds in thu amount of FORTY-THREE THOUSAND ONE HUNDRED FIVE AND 42/100 DOLLARS (443,105.12), being the prinoinal sum for which bonds are to be issued as the sate is stated in said final order aocepting the work. Said bonds shall be dated September 3, 1929, being the date when said final order was made, and tneir denomination and respective times of payment shall be as fellows: FORTY (40) bonds of 01000 each, payable two bonds each year in numerical order, commencing with the lowest numbers, on September 3, 1930, and two more of the next higher numbers on the same day of each and every year thereafter until September 3, 1949, both dates inolusive; also TWENTY (20) bonds of T,J.00 each, payable one bond each year in numerical order, commencing with the lowest numbers, on September 3, 1930, and one more of the next higher number on the same day of each and every year thereafter until September 3, 1919, both dates inelusive; also ONE (1) bond of 01000 and ONE (1) bond of 0105.42 on September 3, 1949. Said bonds Shull be substantially in the following form, to-wit: AWJISITION AND IMPROVEMENT DISTRICT BCND Acquisition and Improvement District No. Two of the City of Alameda, State of California. '41.'1.660 Bond ..... Series A. Under and by virtue of an act of the Legislature of the State of California, known as the "Acquisition and Improvement Act of 1925", the City of Alameda, State of California, will pay to the bearer, out of the fund hereinafter designated, at the office of the treasurer of said city, on the 3rd day of Sept,wber, 19..., the sum of ................dollars in gold eoin of the United States of America, with interest thereon in like gold coin at the rate of six (6) per cent per annum, payable saml-annually on the second day of January and the second day of July in each year from the date hereof (except that tN first interest payment will be made on the second day of January next succeeding one year after the date of this bond and the last installment of interest payment will be paid at the maturity of this bond) upon the presentation and surrend- er, as tiey respectively become due, of the proper interest coupons hereto attached, the first of which is for interest from the date hereof to tle second day of January next succeed- ing one year after the date of this bond, and the last for interest to the maturity hereof from the last preceding date of interest payment. This bond is issued under and in conformity with the provisions of the above mentioned "Acquisition and. Improvement Act of 1925" and is one of a series of bonds to be issued to represent the expenses of certain public improvements authorized by the provisions of said net and comprehended in the proceedings had for the above named distriot. It is hereby certified, recited and de- clared that all proceedings, acts and things required by law precedent to or in the issuance of this bond have been regularly had, done and performed, and this bond is by law made conclusive evidence thereof. This bond is payable out of the "Acquisition and Improvement District No. 2 of the City of Alameda interest and sinking fund" exclusively, as the said fund appears upon the books of the treasurer of said city and neither said city nor any officer thereof shall be holden for its payment otherwise; but in accordance with the provisions of said act a special assessment tax will be levied and col- lected upon the lands in said district in an amount clearly sufficient to pay the principal and interest of said bonds as the same shall become payable. In witness whereof the city council of the said city has caused this bond to be signed by the treasurer of said city and the seal of the city council of said city to be affixed this 3rd day of September, 1929. They shall be signed by the treasurer of said city, and shall have the seal of this city council affixed thereto. The interest payments on said bonds shall be payable January 2nd and July and of each year, except that the first interest payment shall be made on January and, 1931, and the last interest payment at the maturity of said bonds. Said -interest coupons shall be signed by said treasurer, by his written or engraved facsimile signature. It is hereby ordered that a certified copy of this resolution be transmitted to the city treasurer of the City of Alameda. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 15th day of October,1929, by the following vote, to-wit: AYES: Councilmen Brodersen, Calcutt, Henning, Latham and Preeident Schaefer, (5).NOES: None.
