IN THE MATTE. )2 TEE ACQUISITION AND IMPROVEMENT," DISTRICTED. 3 OE 'SIFT IY 02 L0 JA RESOLtiTION end RDER THE iSUANCE 02 BONDS WHEREAS, on January 21, 1930, this City Council adopted its Resolution of Intention to order Certain work to be done and improvements to be made in the above-entitled matter, under and pursuant to the provisions of the Acquisition and ImproVement Act of 1925, reference being hereby expressly made to said Reso- lution of Intention for further partieulars; 5nd MICREAS, said work has been done, and declaration of completion filed and a hearing held thereon after notice, all in accordance with the provisions of sec- tions 23 and 24 of said Aot; and said work having been accepted by this Council, now, therefore, it is hereby RESOLVED AND ORDERED that upon the expiration of twenty days from the gate of said final order of acceptance, the clerk of this Council shell transmit to the Tteaaurer an attested oopy of said final order, upon the receipt of which the Treasurer shall proceed to issue bonds in the amount of TWENTY-NINE THOUSAND TINE HUNDRED iTI2TY and 03/100 DOLLARS ($29,550.03), being the :principal sum for whioh bonds ere to be issued es the same is stated in said final order accepting the work. Said bonds shell be dated August 19, 1930, being the date when said fined order Das made, and their denomination and respective times of paument shall be as follows: Twenty (20) bonds of 0.,000 sechs payable one bond each year in numerical order, commencing With the lowest number, on August 19, 1931, &ad one more of the next higher number on the some day of each and every year thereafter until August 19, 1950, both dates inclusive; also Nineteen (19) bonds of '41:500 each, payable one bond each year in numerical order, commencing with the lowest number, on August 19, 1931, and one more of the next higher number on the same day of each and every year thereafter until August 19, 1949, both date a inclusive; also One (1) bond of .50.03 on August 19, 1950. Series 4 Under end by virtue of en not of the Legislature of the State of California, known as the "Acquisition and Improvement Act of 1925, the City of Alameda, State of California, will pay to the bearer, out of the fund hereinafter designated, at the office of the treasurer of said city, on the 19th day of August, 15....., the 202 of in gold coin of the United States of America, with interest thereon in like gold coin at the, rate of six (5) per cent per annum, payable semi-annually on the second day of January and the second day of July in each year from the date hereof (except that the first interest payment will be made on the second day of January next succeeding one year after the date of this bond and the last installment of interest payment w111 be paid et the maturity of this bond) upon the pre- sentation and surrender, as they respectively become due, of the proper interest coupons hereto attached, tha first of which la for interest from the date hereof to the second day of January neott succeeding one year after the date of this bond, and the last for interest tc the mnturity hereof from the last preceding date of interest payment. This bond is issued under and in conformity with the pro- visions of the above-mentioned "Acquisition and Improvement kot of 1925" and is one of a series of bonds to be issued to repre- sent nr 8)(10511202 of certain public improvements authorized by the provisions of said act end comprehended in the proceedings had for the above-named district. 'It is hereby certified, recited end declared that ell proceedings, acts end things required by law precedent to or in the issuance of this bond have been reg- ularly had, done and performed, end this bond is by low made eon- elusive evidence thereof. This bond is payable out of the "Acquisition ilad Improvement District No. 3 of the City of Alameda interest and sinking fund"exa elusively, as the said fund appears upon the books of the treasurer of said city and neither said city nor any officer thereof shall be holden for its payment otherwise; but in accordance with the pro- visions of said act a special assesement tax will be levied and collected upon the lands in said district in an amount clearly suf- ficient to pay the principal and interest of said bonds an the same shall become payable. It is hereby ordered that a certified copy of this resolution be trensmitted to the city treasurer of the City of Alameda I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda, in regular meeting assembled on the 2nd day of September, 1930, by the following vote, to-wit: AYES: Councilmen Drodersen, Calcutt, Henning, Latham and Rresident Schaefer, (5). 301S: None ABSENT: None.
