AUTHORIZING SOUTHERN PACIFIC COMPANY TO SUBSTITUTE 0CND OF PACIFIC INDEMNITY .[TY COIt,PANY FOR BOND OF UNITED STATES FIllELITY AND GUARANTY COMPANY TO GUARA=E PERFORMANCE OF CONDITIONS OF FRANCHISE GRANTED BY ORDINANCE N0. 504 ADOPTED,ANTD APPROVED SEPTEMBER 28, 1908. WIEE',tEAS, a communication has been received from Southern Pacific Company transmitting surety bond in the amount of Five Thousand (5,000) Dollars in favor of the City of Alameda, executed by Pacific Indemnity Company as Surety and asking that said bond be substituted for the existing bond executed by United States Fidelity and Guaranty Company on file with the City, which was given as guarantee for faithful performance of all the conditions of the franchises for certain electrical lines struck off, sold and awarded on the 4th day of September, 1908, and described in Ordinance No. 504, adopted and approved September 28, 19C8; now, therefore, BE IT RESOLVED by the Council of the City of Alameda that the Southern Pacific Company be, and it is hereby permitted to give a bond of the Pacific Indemnity Company, a Calif- ornia corporation, in the sum of Five Thousand (5,000) Dollars as a substitute for the exis- ting bond of the United States Fidelity and Guaranty Company now on file with the City Clerk which was given as a guarantee of faithful performance of all of the conditions of the franchises for said electrical lines sold and awarded on the 4th day of September, 1908, and described in said Ordinance No. 504, provided said substitute bond be approved by the City Attorney es required by the City Charter. BE IT FURTHER RESOLVED that upon the approval of said substitute bond, as aforesaid, the United States Fidelity and Guaranty Company be, and it is hereby released from all future liability under the bond filed by said Company in 1923, and accepted by Resolution No. 663, adopted August 21, 1923. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 1st day of November, 1932, by the following vote, to wit: AYES: Councilmen Leydecker, Morris, Shanly, Schaefer and President Murry (5).
