ENDORSING EMPLOEThIIiNT OF MILTON SEV ER.
WHEREAS, a question has been raised as to the authority of the Mayor and
City Council over members of the Board of Education and Board of Library
Trustees, by reason of the recent adoption of an amendment to Section 20,
Article XIII of the City Charter of Alameda, and
WHEREAS, it is desirable to secure a court decision on the question, and
because of the fact that the City Attorney is legal advisor of all the parties
involved, it is necessary to employ an outside attorney in the matter; and
WHEREAS, the City Attorney has recommended the employment, for that purpose,
of Attorney Milton Sevier, therefore, be it
RESOLVED that Milton Sevier be, and he is hereby, employed on behalf of the
City of Alameda to commence and prosecute the necessary 1ea1 action or proceeding
for securing a determination of the question hereinbefore mentioned.
RESOLVED, that the sum of 0500.00 or so much thereof as may be necessary, in
addition to the present budget, be, and the same is hereby, appropriated for said
litigation.
I, the undersigned, hereby certify that the foregoing Resolution was duly and
regularly introduced and adopted by the Council of the City of Alameda in remular
meeting assembled on the 7th day of May, 1935, by the following vote, to wit:
