DIRECTING TIE CITY ATTORNEY TO BRING AN ACTION TO RESTRAIN
BOARD OF PUBLIC UTILITIES FROM CONSTRUCTING A STB-STATION.
WHEREAS, since the last regular meeting of the City Council, the Board of Public
Utilities annonneed its intention of proceeding with the construction of an electric
sub-station on the corner of Eagle Avenue and Mlnturn Street, in the City of Alameda,
notwithstanding such action would be in violation of the Zone Ordinance of the City;
therefore, be it
RESOLVED, by the Council of the City of Alameda, that the City Attorney be, and
he is hereby, ordered to bring a suit for and in behalf of the City of Alameda restrain-
ing or enjoining the Board of Public Utilities from receiving or opening bids, awarding
or entering into contracts, or taking any other action in relation to or in connection
with the construction of an electric sub-station on the property aforementioned.
RESOLVED, that the City Attorney be, and he is hereby authorized and empowered to
employ the Honorable T. C. West as counsei to assist him in the bringing and prosecution
of said suit.

I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted by the Council of the City of Alameda in special
meeting assembled on the 13th day of December, 1935, by the following vote, to-wit:
AYES: Councilmen Broyles, Munro and President Roebke, (3).
NOES: None.
ABSENT: Councilmen Eachen and Morris, (2).
IN WITNESS WHEREOF, I have hereunto set my hand and affixed the official seal
of said City this 14th day of December, 1935.
