EXTENDING THE TIME FOR PAYMENT OF MONEY RENTALS PAYABLE BY
ALAMEDA AIRPORT, INC. UNDER CONTRACTS OF LEASE DATED RESIECT-
IVELY AUGUST 7, 1928 AND DECEMBER 3, 1929.
HEREAS, pursuant to Ordinance No. 368 IT.S. of the City of Alameda, passed
by the Council of said City on June 5, 1928, a certain indenture of Lase was executed
by the City of Alameda, as lessor, and Chadwick Thompson and Virgil G. Skinner, as
lessees, bearing date of August 7, 1928, and leasing certain lands of the City of Alamed
in seid lease described; and
WHEREAS, said lease thereafter was duly assigned by the lessees therein
named to Alameda Airport, Inc., a cerporation; and
MEREAS, pursuant to Ordinance No. 415 N.S. of the City of Alameda, passed
by a vote of the people of the City cf Alameda at an election held November 5,1929,
a certain indenture of lease was executed by the City of Alameda, as lessor, and
Alameda Airport, Inc., a corporation, as lessee, bearing date of December 3, 1929,
leasing certain lands cf said City in said lease described; and
WHEREAS, the annual rent reserved to 'said City and payable by said Alameda.
Airport, Inc., to suod City under the terms of the aforesaid leases is payable annually
in advance on the 7th day of August, or within ten days thereafter, of each end every
year during the terms of said leases; and
WHEREAS, at the request of said Alameda Airport, Inc., the time within which
said Alameda. Airport, Inc. might pay to the City of Alameda the rental money payable
to the City of Alameda under the terms of the said leases has heretofore been extended,
by Resolutions Nos. 2187 and 2196, adopted by the Council of said City on August 16,
1937 and September 20,1937, respectively, from August 7, 1937, or within. ten days
thereafter to and including October 20, 1937; and
WHEREAS, Alameda Airport, Inc. has requested that the time within which
said Alameda Airport, Inc. may pay to the City of'Alameda the rental money payable
to the City of Alameda under the terms of the aforesnid leases, be further extended;
NOW THEREFORE, DE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that
the time within which Alameda Airport, Inc. may pay to the City of Alameda the
annual instalment of money rental payable under the terms of said two certain leases
dated respectively August 7, 1928 and December 3, 1929, and bereinbefore in the
preamble to this resolution particularly described, and which has been heretofore
extended By Resolutions Nos 2187 and 2196, adopted by the Council of said City on
August 16,1937 and September 20, 1937, respectively, to and including October 20,
1937, be and the same is hereby further extended to and including December 20,1057;
3E IT FURTHER RESOLVED that the extension of time by this resolution grunted
stall apply to and shall be and it is hereby limited to rentals payable under the terms
of said leaees on August 7, 1937, or within ten lays thereafter, and that after
December 20, 1937, rentals becoming due and payable under said leases, or either of
them, shall be paid pursuant to the terms of said leases in the manner and at the times
required by said leases as though this resolution had not been adopted;
BE IT FURTHER RESOLVED that nothing in this resolution contained shall be
deemed or construed to be a waiver of any default under the aforesaid leases, or either
of them, nor as amending or modifying any of the terms or conditions or covenants of
said leases, or either of them, save and except as herein in this resolution expressly
provided, nor as limiting, abrogating, modifying or impairing any rights of the City
of Alameda under said leases, or either of them, nor as a waiver of the right of the
City et Alameda to claim or assert a default on the part of Alameda Airport, Inc.
in respect of any of the terms, conditions or covenants of said leases, or either of
them, if any there now be, Or in resnect of any default which may hereafter occur, nor
a waiver of demand heretofore made by the City of Alameda upon said Alameda Airport,
Inc., requiring performance on the part of said Alameda Airport, Inca of certain
covenants contained in said leases for the reclamation, filling and grading of the
lands in said leases described, which demand was set forth in Resolution No. 2167,
adopted by the Council of said City on June 15, 1937.

and regulerly introduced and. adopted by the Council of the City of Alameda in regular
meeting assembled on the 19th day of October, 1937, by the following vote, to wit:
AYES: Councilmen Godfrey, Morris and President Weichhart, (3).
NOFS: None. ABSENT: Councilmen Carrington and. naurer, (2).
