AUTHORIZING TEE EXECUTION OF ESCROW INSTRUCTIONS AND THE
DELIVERY OF THE AGREEMENT OF COMPROMISE AND DEED OF GRANT
REFERRED TO IN ORDINANCES 616 AND 617, NEW SERIES, OF TUE
OTTE OF' ALAMEDA
WHEREAS on October 25, 1037, the Council cf the City of Alameda duly and
regularly adopted Ordinance No. 616, New Series, entitled,
AUTHORIZING THE EXECUTION OF AN AGREEMENT OF
COMPROMISE SETTLING ALL DISPUTES NOW AND
HERETOFORE EXISTING BETWEEN THE CITY OF XLEMEDA
AND ALAMEDA AIRPORT, INC., UNDER CERTAIN LEASES,
authorizing, among other things, the execution of a compromise agreement between the
City of Alameda and Alameda Airport, Inc., a corporation, and
WHEREAS or. October 2E, 1937, the Council of the City cf Alameda duly and reg-
ularly adapted Ordinance No. 617, New Series, entitled,
AUTHORIZING 977 EXECUTION OF A DEED OF GRANT
CONVEYING TO THE UNITED STATES OF AMERICA
CERTAIN TIDE AND SUBMERGED LANDS IN THE CITY
OF ALAMEDA,
authorizing the axecutien, by and on behalf of the City of Alameda, of a Deed of Grant
conveying to the United States of Amerida certain tide and submerged lands situated
in the City of Alameda, and
WHEREAS, in order to accomplish the objects specified in said Ordinances it
is necessary that the documents therein provided to be executed be placed in escrow
in order to effectuate delivery thereof,
N07 THEREFORE, BE IT RESOLVED that the Mayor of the City' of Alameda be and he is
hereby authorized and directed to execute,. on behalf of the City of Alameda, and jointly
with Alameda Airport, Inc. and the United States of America, writteD escrow instructions
in form substantially, as follows:
ESCROW INSTRUCTIONS
To ALAIDEDA COUNTY-EAST BY TITLE ENDURANCE CO.
14th and Franklin Streets
Oakland, California
Gentlemen:
On or before the hour of 11 o'clock of the forenoon of November 26, 1657, there will be
deposited with you the following documents, which you will deliver and dispose of as
hereinafter directed.
Item 1: A compromise agreement executed in duplicate between the City of Alameda and
Alapeda Airport, Inc., approved as to form by the City Attorney of the City of Alameda,
and by F. G. Athearn.
Item 2: A grant deed, wherein the City of Alameda is the Grantor and the United States
of America is the Greantee, approved as to form by the City Attorney for the City of
Alameda and the United States District Attorney at San Francisco, California.
Item 3: A revocable permit issued by the United States Government, acting through the
Secretary of the Navy, to Alameda Airport, Inc., approved as to form by F. G. Athearn.
Item 4: A revocable permit issued by the United States Government, acting through the
Secretary of the Navy, to Pan American Airweys Company, approved as to form by F. G.
Athearn.
Item 5: A certain sum. of cash, a d firm obligations, endorsed payable to Alameda
Airport, Inc., and approved as to fomi and amounts by' F. G. Athearn, in the total aggre-
gate sum of N00,660.00.
If tho above enumerated items are not deposited with you within the time limited above,
you will return each item to the person or corporation depositing the same with you, save
and except that with respect to Item 1 you rill cancel both copies by destroying the
signatures thereon and than returning one copy to the City of Alameda are the ether to
F. G. Athearn, If, horever, all of such items are deposited with you within the time
limited, you will make disposition of all of them as follows:
Item I:, You will cause ore copy to be recorded in the County of Alameda with. directions
to deliver the same to the City of Alameda and the other copy- you will deliver to F. G.
Athearn as a representative of Alameda Airport, Inc.
Item 2: Yon will geese this item to be recorded in the County cf Alameda subsequent in
in time to the recordation of Item 1 above, and direct that the same, velen recorded, he
delivered to the Commandant of the Twelfth Naval District et San Francisco, California,
for the United States of America.
Item 3: To F. G. Athearn, as the representative of Alameda Airport, Inc.
Item 4:: To F. G. Athearn as the representative of Pan american Airways Company.
Item 5: To F. G. Athearn, as the representative of Alameda Airport, Inc.
