AUTHORIZING THE CITY ATTORNEY TO EXECUTE STIPULATION WITH
ThE ALASKA TACK= ASSOCIATION WITH REGARD TO CERTAIN
LITIGATION.
WHEREAS in un action commenced in the Superior Chort of the State of Calif-
ornia, in and for the County of Alameda, entitled Alaska Packers Association, a corpor-
ation, plaintiff, vs. William F. Whitaker, at al., defendants, and numbered 146062, the
plaintiff therein prays for judgment quieting its title against the defendants therein
named, including the City or Alameda to certain premises more particularly described
in the. complaint therein, and
2HEI1L3 the City of Alameda has heretofore filed its answer in said actien,
claiming ownership of certain easements and rights of way far sewer and for street and
highway purposes and for high power electric lines in and along certain portions of
the premises described in said complaint, and
WHEREAS a written stipulation has been prepared and submitted tc this Council
at this Meeting, Therein and Whereby it is stipulated between the parties to said action
that judgment may be rendered in favor of the Plaintiff in said action, quieting
Plaintiff's title to the premises described in said complaint, but saving and reserving
to the City of Alameda all of the easements and rights, of way claimed by said City in
its said answer,
NOW' THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the
City Attorney of the City of Alameda be and he is hereby authorized to execute on
behalf of the City of Alameda the aforesaid stipulation.

and regularly introduced and adopted by the Council of the City of Alaneda in regula.
meeting assembled on the 18th day of Januory,1036, by the following vote, to wit:
AYES: Councilmen Maurer, Morris and President Weichhart, (3).
NOES: None.
ABSENT: Councilmen Carrington and Godfrey, (2).
