Resolution 02239RESOLUTION NO. 2239 ORDERING THE CLOSING OF THAT PORTION OF VERSAILLES AVENUE FROM THE SOUTHERLY LINE OF OTIS DRIVE ( FORMERLY BY ISLAND AVENUE) TO THE SOUTHERLY TERMINaTION OF SAID VERSAILLES AVENUE IN THE CITY OF ALAMEDA. VEREAS the Council of the City of Alameda did, on the lbth day of March, 1938, pass a resolution declaring its intention to order the closing up of that portion of Versailles Avenue from the southerly line of Ctis Drive (formerly Bay island. Avenue) tc the southerly termination of said Versailles Avenue, in the City of Alameda, County of Alameda, State of California, and WHEREAS no land was deemed necessary to be taken, or will be taken, for the work and improvement of closing said street, and the exterior boundaries of the district of lands to be affected or benefitted by said work or improvement, and to be assessed to pay the damages, costs and expanses thereof, ere the corporate boundaries of the City of Alameda, and WHEREAS it appears that it ie. not necessary to assess any lands to pay the damages, costs and expenses of said improvement, and WHEREAS on the 22nd day of March, 1238, the Street Superintendent of the City of Alameda caused to be conspicuously posted along the lines of said contemplated work and improvement, at not more than 300 feet in distance apart, and not less than three in all, notices of the passage of said resolution, in time, form and manner required by law, and MEEREAS the said Street Superintendent also caused a notice, similar in substance, to bepublished for a period of ten days in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said City and designated by said Council for that purpose, said publication commencing on the 17th day of March, 1038, and continuing thereafter in each and every issue of said newspaper until and including the 26th day of March, 1938. AND '.,,:HEREAS proof of said posting and publication is evidenced by affidavits on file in the office of the City Clerk of said City, and WHEREAS no person interested or objecting to said work or improvement, or tu the extent of the district of lands to be affected or benefitted by said work and improvement and to be assessed to pay the costs and expenses thereof, has made written objection to said work and improvement, and no written objection to said work and improvement has been filed with said City Clerk, within ten days after the expiration of the time of the publication of said notice, or at any time or at all, and WHEREAS the time presbribed, during which objections to said work and im- provement could he made, has expired, and this Council having acquired jurisdiction to take action in said matter, and WHEREAS public interest and convenience require tie closing up of said portion of said avenue and street, NOW iHEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAKEDA that that portion of Versailles Avenue from the southerly line of Otis Drive (formerly Bay Island Avenue) to the southerly termination of said Versailles Avenue in the City of Alameda, County of Alameda, State of California, be, and the same is hereby ordered to be, closed and abandoned. I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 19th day of April, 1936, by the following vote, to-wit: AYES: Councilmen Carrington, Godfrey, Morris and President Weichhart, (4).
