Resolution 02347RESOLUTION NO 2347 GRANTING PERMIT TO THE PACIFIC TELEPHONE AND TELEGRAPH COPPANY OVER CERTAIN STRIPS DESIG- NATED AS "RESERVE" ON THE FILED MAP OF "TRACT 526 ALAMEDA ALAIAEDA COUNTY CALIFORNLA." W.EREAS, there was filed in the office of the County Recorder of Alameda County, in Libor 3742 of Official Records, at Page 64, on January 26, 1939, a certain grant by Windsor, Cohen et al, to the City of Alameda, granting said City the right to use and the right to permit others to use, certain strips designated "Reserve" on the filed map of "Tract 526, Alameda, Alameda County, California", for the purpose of rendering various public utility services; and WHEREAS, it is the desire of the owners of said tract and alao in the public interest that all pole lines, overhead wires and cables and the appurtenances thereto be located on said "Reserve" strips rather than on the public streets of the tract; and WHEREAS, the Council of the City of Alameda finds it convenient and not detrimental to the interests of the City to use said strips for jointly owned poles and pole lines with The Pacific Telephone and Telegraph Company; BE IT THEREFORE RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that a permit be, and is hereby, granted to The Pacific Telephone and Telegraph Company to construct, maintain and/or erect poles and pole lines, underground conduits and manholes, cables and wires, over, under, along and/or across said "Reserve" strips, for the purpose of rendering telephone and telegraph services; with the right of ingress to and egress from said strips; under the condition that said The Pacific Telephone and Telegraph Com- pany in the use of said strips, shall construct and/or maintain its structures in con- formity with all State, County, or City law, ordinances, resolutions or orders pertain- ing to such construction, as may be currently in force or enaeted in the future; and under the further condition that any specific usage of said strips by The Pacific Telephone and Telegraph Company shall be in conformity with all such laws, ordinances and resolutions and shall be approved by the General Manager of the Public Utilities Board or other of- ficers of the City of Alameda having jurisdiction in the premises. the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day of April, 1939, by the following vote, to wit: AYES: Councilmen Carrington, Godfrey, Maurer and President Weichhart, (4).
