"Carrie L. Miller, Plaintiff, vs. City of Alameda, a Municipal corporation, et al., Defendants", numbered 153539 on the records and files cf said court; and '611EREAS, summons and complaint in said action have been heretofore served on the City of Alameda; and WEERNAS, said. action is one tthereon the plaintiff seeks to quiet her title against the defendants named. In said complaint to certain lands situated in the City of Alameda and in satd complaint more particularly described; and WHEREAS, it appears to this Council that the northeastern three feet of the promises described in said complaint, shown on the "Map of the High St. Briggs Tract, Alameda Township, Alameda County, State of. California", filed Iuly 24, 11110- in boor 4 of YnTs at page 22, in the office of the County Recorder of Alameda County, as a publics street or highway was not at any time accepted by the City of Alameda as a public street or higHway, and is not now and has never been in fact used as a public street or highway; and NEEREAS, it appears from the records and filea of Inc City of Alameda and the records of the office uf the County' Auditor of the County of Alameda. that the City of Alameda has no estate, right, title or interest in the premises described in said complaint; NOb' THEREFORE BE IT RESOLVED HY THE COUNCIL OF THE CITY OF ALAMEDA that the Mayor and the City Attorney' of said City be, and they are hereby, authorized and directed . to execute on brd of the City of Alameda and to file in said. action an answer and disclaimer wherein the City of Alameda. shall dis- claim any and all right, title, lien, interest or estate in, to or upon the real proterty and premises described in said complaint.
