Resolution 02482RESOLUTION NO. 2482 AUTHORIZING EXTENSION OF TIME FOR JOINT OPERATION WITH CCURTY OF ALAMEDA OF FRUITVALE AVENUE BRIDGE; APPROVING FORM AND AUTHORIZING EXECUTION CF FOURTH SUPPLEMENTAL AGREEMENT. ZiEREAS, pursuant to the terms of that certain "Supplemental Agreement", dated January 24, 1940, made by and between the County of Alameda and the City of Alameda, the City cf Alameda and said County have engaged in the joint operation of the Fruitvale Avenue Bridge; and WHEREAS, it is necessary and in the public interest that the period of time or the joint operation of said bridge be extended to July 1, 1940; and WEEREAS, a form of contract entitled "Fourth Supplemental Agreement" and providing for the extension of the period of the joint operation of said bridge to July 1, 1940 has been presented and submitted to this Council, a copy of which Fourth Supplemental Agreement is hereto attached and made a part hereof; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA that the period for the joint operation by the County of Alameda and the City of Alameda of the said Fruitvale Avenue Bridge be, and the same is hereby, extended to July 1, 1940, said joint operation to be carried out in accordance with and subject to all the terms and conditions contained in said Supplemental Agreement; and the Mayor of the City of Alameda is hereby authorized and directed to exeouta and the City Clerk to attest, for and on behalf of the City of Alameda, an agree- ment substantially in the form of the aforesaid Fourth Supplemental. Agreement, RESOLVED, FURTHER, that the SUE. of $600.00, or so much thereof as may be necessary, be, and is hereby, appropriated from the General Fund of the City of Alameda, Budget Account 70b, to pay for the City of AlsmedaTs share of the cost of operation of said Fruitvale Avenue Bridge, as provided in said agreements. FOURTH SUPPLEMENTAL AGREEMENT THIS FOURTH SUPPLEMENTAL AGREEMENT, made and entered into the 21st day of May, 1940, by and between the COUNTY OF ALAMEDA, State of California, acting by and through its Board of Supervisors, who are duly authorized, hereinafter designated as the first party, and the CITY CF ALAMEDA, a municipal corporation, hereinafter designated es the second party, WITNESSETH: IT IS =EBY MUTUALLY UNDERSTOOD AND AGREED that the period of time for the joint operation of the Fruitvale Avenue Bridge as provided by that certain "Suonlemental Agreement" dated the 24th day of January, 194C, and entered into by and between the parties hereto, be and the same is hereby extended to July 1st, 1940, subject to all the terms and conditions contained in said "Supplemental Agreement". IN WITNESS WHEREOF, the COUNTY OF ALAMEDA, acting by and through its Chairman of ite Board of Supervisors, has caused its name and seal of the Board of Supervisors to be hereunto affixed, and the CITY OF AEWEDA, acting by and through its City Council, has caused its name and seal to be hereunto affixed, all in duplicate, the day and year first above written.
