CANCELLING CITY TAXED ON REAL PRUPERTY ACI4,UIRE0
BY THE VETERANS WELFARE BOARD OF THE STATE OF
CALIFORNIA.
WHEREAS, the City of Alameda heretofore assessed and levied taxes for
general municipal purposes against a certain parcel of real property situated in
the City of Alameda, County of Alameda, State of California, which real property
was assessed to W. A. Netherby and Ella M. Netherby for the fiscal year 1928-29,
and which taxes were levied thereon for such fiscal year in the sum of 4149.47,
the parcel of land hereinbefore referred to being more particularly described as
follows:
Lot No. 455 in Block X, as said Lot and Block are delineated
and so dewignated upon that certain Map entitled "Fernside,
Alameda, California", filed June 9, 1925 in Liber 4 of Maps,
at page 76, in the office of the County Recorder of the County
of Alameda;
and
WHERBAJ, it satisfactorily appearing to this Council from the verified
petition of the Beterans' Welfare Board of the State of California bearing the
date of July 12, 1940 and on file with the Council of the City of Alameda, and
this Council upon satisfactory proof thereof so finds, that after the time that
said assessments and taxes became a lien on the said parcel of real property said
parcel of real property was acquired and owned, and ever since has been and now
is owned, by the Veterans' Welfare Board of the State of California, a public
corporation, and because of such public ownership is not subject to sale for de-
Unguent taxes; and
WHEREAS, the aforesaid taxes and assessments levied on said parcel of
land, in the amount hereinbefore set forth, are uncollected and unpaid;
NOW, TEEEEYORE, BE IT RESOLVED BY THE COUNCIL 0? THE CITY OF ALAIETTJA,
the written consent of the City Attorney of the City of Alameda having been given
heretofore as required by law, that the aforesaid uncollected taxes and assess-
ments charged cr levied by the City of Alameda for city purposes upon the afore-
said parcel of real proeerty, together with all penalties and costs thereon be,
and the same are hereby, cancelled, and the Auditor and Tax Collector or other
officer of the City of Alameda having the custody of the record thereof, are
hereby authorized and directed to cancel such taxes and assessments so levied
or charged, together with all penalties and costs thereon, and to make appropriate
entries and record of such cancellation on their respective hooks; and
BE IT FURTHER RESOLVED, anything in this resolution to the contrary
notwithstanding, that this resolution and order shall not be construed as can-
celling or authorizing the cancellation of any taxes or assessments levied or
charged against any possessory interest in said parcel of real property or of
any special assessment taxes levied against said parcel of real prcperty by the
City of Alameda pursuant to the provisions of the "Acquisition. and Improvbmbnt
Act of 192:5".

I, the undersigned, hereby certify that the foregoing resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 6th day of August, 1940, by the following
vote, to wit:
AYES: Councilmen Carrington, Godfrey, Maurer, Morris and President
Oeichhart, (5).
NOES: None.
ABSENT: None.
