Resolution 02515RESOLUTION NO. 2515 AUTHORIZING PERFORMANCE SD CONTLETION OF A PROJECT FOR TIE eal‘ROVE-PIINT OF MAIll STREET AND ATLANTIC AVENUE In THE CITY OF ALAMEDA AND DIRECTING THE CITY CLERK TO ADVERTISE FOR SEALED BIDS. WHEREAS, the City of Alameda, pursuant to the provisions of the Streets and Highways Code of the State of California and the rules and regulations pro- mulgated thereunder for administering the provisions thereof, submitted to the Director of Public Works of the State of California its project for the construc- tion of Main Street from the North curb line of Pacific Avenue, north and wester- ly, for a distance of 9150 feet, and Atlantic Avenue from the Westerly line of Main Street, 1152 feet to the Peralta Grant Line, consisting of grading, con- structing a rock material fill 46 foot roadway of 3" A. C. Type "3" wearing sur- face or, a 7" crusher base, 3 foot shoulders with a Class "B" seal coat; install- ing culverts and wing walls, constructing concrete curb, gutters, gutter bridges, catchbasins and all incidental work pertaining to the same; and AHEREAS, said project and construction work therein contemplated have been approved by said Director of Public Works, and the moneys required to cover the cost of said project have been allocated, and the expenditure thereof author- ized and approved; and . WHEREAS, a contract or "Memorandum of Agreement" between the City of Alameda and the Department of Public Works of the State of California providing for the expenditure of the 1/44 per gallon tax on motor vehicle fuel oil allo- cated for Streets of Major Importance in the City of Alameda was heretofore jointly executed by the City on August 21, 1940 and by the Department of Public Works on August 28, 1940; and WHEREAS, plans and specifications for the improvement and work here- - inbefore referred to have been prepared by the City Engineer of the City of Alameda and approved by said. Director of Public Works, and filed in the office of the City Clerk of said City on the 3rd day of Deptember, 1940, and numbered PJ 9-402; NOW, THEREFORE, BE IT RESOLVED BY TILE COUNCIL OF TEE CITY OF ALAMEDA ttat the aforesaid plans and specifications be, and the same are hereby, approved and adopted. RESOLVED FURTHER that the performance and completion of the work specified in said project and in said plans and specifications be, and the same is hereby, authorized. RESOLVED FURTHER that the City Clerk be, and she is hereby, authorized and directed to advertise for sealed bids for the furnishing of labor and ma- terial required for the completion of said project and improvement, in accord- ance with said plane and specifications. Double time Saturday afternoons, Sundays and Holidays. Carpenters: Time and one-half for the first four hours, double time thereafter. Double time on Saturdays, Sundays and Holidays. Shift Work: Two or more consecutive shifts, seven (7) hours work at eight (8) hours pay. RESOLVED FURTHER that it shall be mandatory upon the contractor, and upon any sub-contractor under him, to pay not less than the said specified rates to all laborers, workmen and mechanics employed by them in the execution of said work and the contract therefor. RESOLVED FiMTHSER that each bid aball be accompanied by a cashier's check or a certified check, on a responsible bank, in a sum equal to ten per cent (105) of the aggregate amount of the bid, payable to the City of Alameda, to be forfeited to said City as agreed and liquidated damages should the party cr parties to whom the contract shall be awarded fail to enter into a contract for the performance and completion of such work or to give bonds, as required by law and by said plans and specifications. RESOLVED FURTHER that such sealed bide will be received by the City Clerk of the City of Alameda at the City Hall until Tuesday, the 10th day of September, 1940, at 5:00 o'clock P. M. of said day. A21 bids must be in writing. The Council reserves the right to reject any and all bids. RESOLVED FURTHER that prospective bidders for the work above listed may secure a complete copy of said plans and specifications by applying therefor at the office of the City Engineer of the City of Alameda in the City Hall in said City and by depositing with said City Engineer the sum of 4,25.00 for each such eopy. Said plans and specifications shall be returned, in good condition to the office of said City Engineer not later than 10 days after the date upon which the bids are opened for the above mentioned work, and upon said return of plans and speoifications said deposit will be returned. If the plans and opecifica- tions are not returned to the office of said City Engineer within the time above specified, or are returned in a mutilated or damaged condition, the said deposit shall be retained by the City of Alameda as agreed and liquidated damages for said mutilation or detention. 1, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 3rd day of September, 1940, by the following vote, to wit: AYES: Councilmen Carrington, Godfrey, Maurer, Morris and President Weichhart, (5).
