Resolution 02522RESOLUTION EC, 2522 RESOLUTION OF INTENTION TO CLOSE FORTICNS OF CLAY STREET AND FILLMORE STREET 153 THE CITY OF EDA. RESOLVED BY TEE COUNCIL OF THE CITY OF ALMJKLA that public interest and convenience require, and said Council hereby declares its intention to order, the closing up of those portions of the following named streets in the City of Alameda, County of Alameda, State of California, described ae follows: (a) Clay Street, from the southeasterly line of Court Street to the northwesterly line of Fountain Street; (b) Clay Street, from the southeasterly line of Fountain. Street to the northwesterly line of High Street; (c) Clay Street, from the southeasterly line of High Street to the northwesterly line of Post Street; (d) Fi1L-nore Street, from the southeasterly line of Nigh Street to the northwesterly line of Poet Street; (e) Fillmore Street, from the southeasterly line of Post Street to the northwesterly line of Peach Street. The portions of said streets to be closed up and abandoned. are more particularly shown in red upon a plat annexed hereto and made a part hereof. RESOLVED FURTILER that no land is deemed necessary to be taken, or will be taken, for the work and improvement of closing said streets, and that the exterior boundaries of the district of lands to be affected or benefitted by said work or improvement, and to be assessed to pay the damages, costs and expenses thereof are the corporate boundaries of the City of Alameda; that no lands will be assessed to pay the damages, cost and expenses of said improve- ment, The Street Superintendent of the City of Alameda shall cause notices of the rassage cf ttis resolution. tc be conspicuously posted along the line of said contemplated work and improvement and in the time, form and manner re- quired by law. Fie shell also cause a notice, similar in substance, to be pub- lished for a period of ten. (10) days and for a period embracing at least four (4) successive semi-weekly insertions, in the Alameda Times-Star, a daily news- paper of general circulation published and circulated in said city, and hereby designated by the said City Council as the newspaper in which said notice shall be published. Any person interested objecting to said work or improvement, or tc the extent sf the district of lane to be affected or benefitted by said work or improvement, and to be assessed to pay the costo and expenses thereof, may make written objections to the same within ten (10) days after the expiration of the time of the publication of said notice, and deliver said. objections to the clerk of the City Council as required. by law. All the herein proposed work and improvement of closing said streets, or parts of streets aforementioned, shall be done under and in pursuance of an act of the Legislature entitled, "An act to provide for laying out, opening, extending, widening, straightening or closing up in whole or in part any street square,' lane, alley, court or place within municipalities, and to condemn and acquire any and all land and property necessary or convenient for that purpose", approved March 6, 1889, (State. 1889, n. 70) and amendments thereto. * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 10th day of September, 1940, by the follow- ing vote, to wit: (4) .
