CONTRACT BETWEEN THE CITY OF ALAYEEA AND TEE COUNTY
OF ALAMEDA FOR THE DISTRIBUTION OF CERTAIN PAYMENTS
IN LIEU OF TAXES TO BE RECEIVED BY TIE CITY OF
ALAIEDA FROM THE UNITED STATES OF AYERICA IN
CONDO:T.1CH WITH NATIONAL DEFENSE HOUSING PROJECT NO.
CAL. 4112.
BE IT RESOLVED BY TEE COUNCIL OF THE CITY OF ALAMEDA as
follows:
That the City of Alameda shall enter into e contract with the County
of Alameda substantially in the following form:
"IN LIEU TAX AGREEMENT
This agreement made this day of , 1941, between the
COUNTY OF ALAMEDA, State of California, hereinafter called .he 'County, and the
CITY OF ALAMEDA, a municipal corporation in the County of Alameda, State of
California, hereinafter called the ?City.
WHIREAS, pursuant to Public No. 649, 76th Congress (the Lanham Act),
The Federal Works Administrator has authorized the development and construction
of a national defense housing project in the City of Alameda to acconuaodete
persons engaged in national defense activities, which project consists of approximate-
ly two hundred units and is known in the records of the Federal Works Agency as
Development No. Cal. 4112; and
WHEREAS, by virtue of the fact that such project and land acquired or to
be acquired in connection therewith and the improvements thereon are owned or are to
be owned by the United States of America, such land and improvements are or will be
exempt from taxation by the parties hereto and by all other political subdivisions
of the State of California; and
WHEREAS, the Federal Works Administrator, by virtue of Section 9 of the
said Lanham Act is authorized to enter into agreements to pay annual sums in lieu
of taxes to the political subdivisions in which any such national defense housing
project raY be situated; and
WHEREAS, the parties hereto understand that the Government of the United
States,. through the Federal Works Administrator will enter into an agreement with
the City of Alameda to pay to the City an annual sum in lieu of taxes, based upon
a percentage cf the total annual dwelling shelter rentals charged for occupied units
in said project, such payments to be divided between the County and the City in such
proportions as the parties hereto may agree upon; and
WHEREAS, the parties hereto desire to make provision for distribution bet-
ween them of the sums to be received by the City under such agreement;
NOW, THEREFORE, in consideration of the premises, it is agreed between the
parties hereto that thirty and two-tenths per cent (30.2%) of any sums received
by the City under and pursuant to the terms of the agreement to be made between the
United States of America and the City for payments in lieu of taxes, as aforesaid,
shall belong to the County of Alameda and shall be paid by the City to the County
as and when received. The balecce of such payments shall belong to and be retained
by the City.
IN WITNESS WEEREOF, said County has, by the order of its Board of Super-
visors, caused these presents to be subscribed by the Chairman of said Board and
the Seel of eaid Board to be affixed thereto, and attested by the Clerk of said
Board, and the said City has, by order of its City Council, caused these pro5ote,
to bc s'obsoPibed by the Mayer et' said City, and the Seal of said City to be affixed
thereto, and attested by the Clerk of said City, all in quihtuplioate originals, the
day and year first above written."
RESOLVED, FURTHER, that the Mayer of the City of Alameda be, and he is
hereby, authorized and directed to execute, and the City Clerk to attest, en behalf
of the City, an agreement substantially in the form and containing tbe terms end
conditions set forth in the form hereinbefore set forth.
This resolution shall take effect immediately.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council. of the City of
Alameda in adjourned regular meeting assembled on the 29th day of July, 1941,
by the following vote, to wit:
AYES: Councilrien Cranscheid, Howe, Maurer and President Weichhart, (4).
NOES: None.
ABSENT: Councilman Godfrey. (1)
