WHEREAS, in order to avert further damage to said highwave and public.
ereperty it de necessary that the needed work of repair. and restoration of said
levee be completed. prior to the time when. storme and. floods may again be expected,

Thousand Dollars (F4500,000; was appropriated. to the emergency- fund to be expended

flood. coutrol works irrigation works, city and county roads and bridges and. other
protorty damaged. or destroyed by storm and. flood subsequent to Lanuary I, 1940;

WHEREAS, the City' of Alameda has applied to the State for assistance in.
meetins the cost of repair and restoration of said levee damaged by storms and
floods subsequent to January 1, 1940, as a:no:resold; and.
WHEREAS, the Chief of khe Division of Water Resources, also known as
the State Emsineer, has investigated. the proposed work, has found that the
property has a general public and State interest and that its repair and. restora-
tion is a matter of genemal public anb. State concern, has estimated. the cost of
the work and prepareh. a detailed. budget of expenditure for the work and has filed
his Report No. A-106 thorebh. (inclusive of said. findings, estimate and budgbt;
with the several offimers and departments as required. by low. and said redort has
been approved. by the Direttor of Finance and the State Controller; and
WHEREAS, it is estimated in said report that the cost of the work of
said repair and restoration of said levee will amount to S2,266.0.0 and the State
J ill contribute one-half of the cost thereof provided the City of Alornede appro-
erictes and riekes available for said. work the sum of $1126.00; and
WHEREAS, a. form of agmeemmnt containing the terms and dendltions to be
agreed. upon between the City of Alameda and the State of' Califernia has been
presepted and read at this meeting and this Coancii. is familiar. with the terms
thereof, which form of agreement is hereby ordarod filed with the City Clerk
