Resolution 02674RESOLUTION NO. 2674 GRANTING PERMIT TO ALAMEDA BELT L TO CONSTRUCT, NAINTAIN AND OPERATE A RAILROAD SPUR TRACK ACROSS CLENENT AVENUE IN THE CITY OF ALAMEDA. HE IT RESOLVED BY THE COUNCIL, OF THE CITY OF ALAMEDA that a permit be, and is hereby, granted to Alameda Belt Line, a corporation, its successors and assigns, to construct, reconstruct and maintain a single railroad spur track, and to operate locomotives, trains or cars thereon ' with steam motive power, on and across Clement Avenue in the City of Alameda, the center line of which spur track is described as follows: Beginning at a point on the center line of an existing track in Clement Avenue, said point lying 77.0 feet westerly from the eastern line of Stanford Street and 30.0 feet northerly from the southerly line of Clement Avenue; thence northeasterly on a curve to the left having a radius cf 235.65 feet, a distance of 115.41 feet to a point in the northerly line of Clement Avenue lying 34.15 feat easterly from the east line of Stanford Street. This permit is granted on and subject to the following terms and condi s: 1. That said spur track shall be used for the transportation of freight only. 2. That said spur track shall be constructed and maintained level with the ground, and that all construction, operation and maintenance work snail be performed without cost or expense to tic City of Alamdde. 3. That ull switch movements over such Spur track shall be so con- ducted as not to block longer than is necessary for ordinary switching operations the streets which are crossed by such spur track. 4. That the permit hereby granted shall be revocable at the pleasure of the Council el the City of Alameda. 5. That on revocation of this permit the Permittee shall, at its owm coot and expense, forthwith remove said epur track and repave, macadamize cr otherwise restore the portions of the street damaged or disturbed by such re- moval, using the same kind of material and construction as shall be used by the City of Alameda upon the portion. of the street adjacent to said spur track. In the event tat Parmittee shall neglect or refuse to so remove such spur track or to repair and restore said street as hereinbefore provided, the City of Alameda may cause sash spur track to be removed and the work cf repairing and restoring said street to be done, and Permittee shall thereupon be obligated to pay to the City the cost of such removal and of such repair and restoration. 1, the undersigned; hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assemblect on the ?lot day of October, 1941, by the following vote, to wit: AYES: Councilmen.
