ORDERING TEE CLOSING OF POETROVE OF SECOND STREET,
SICHTBE STREET AND 0GEHRSS STREET IF THE CITY OF
WHEREAS, the Council. of the City of Alomada did, on the 15th day of
April, 1941, pass its resolution Fa. 2578 declaxing its intentich to ordmr the
closing up of those certain portions of Smcond. Street, Spruce StreEt and Cyprems
Street more particularly described ih. said. resolution Of ihtention. as fallowe:
(a) Second Street, from the southerly line of Bruen
Street to a line drawn parallel to film northerify
line of 1:cific, Evenue and distant northerly'
from. said line of Pacific Avenue 150 feet;
(b) Spruce Street, from. the eastmrim lime of Mein
Street to the westerly line of Theird Street;
(ca Cypress Street, from thE easterly line of Main
Street. to the westerly line of Third Street,
situated in thE City of Alameda, County of Alameda, State of California; and
WHEREAS, no land was deemed. nEcessary to be Laken, or '32 ill. 3232 taken,
for the work an3 . improvement of closing s3 ib. streeta, and. the exterior boundaries
of the dIstriet of lands to be affected. or benefited by said work or improvmmbnt,
and. to be 3232 321132) to pay tbe damages, costs and expenses thereof, are tbe cor-
porate 32-32 11; of the City of Alameda; and
WHEREAS, it appears that it ia not nbcessary to assess any lands to pay'
fhm damages, costs .and. expenses of said improvement; and
32 1' on the 21st day of April, 1021 the Street Superintendent of
the City of Alameda caused to be conmpiatiously posted. along the lines of said
contemplated work and. improvement, at not more than SOO feet in distance apart,
and not less than three in all, notices of the passaae of said resolutimt, Pc
time, form and manner required by law; and
WENREES, the said Street Superintendent also caused a notice, elmilar
in substanhe, 3,32 1' putlished for a period. of ten. days, and for at least four
successive semi-weekly insertions, in the Alameda Timem—Star, a daily newspaper
of general circulation published and circulated. in said City and. demianated by
said Council. for that purpose, said publication commencing on. the 22nd. day of
April, 1941, and 32 32 thereafter in each and every issue of said 11' 3213303323211
until and fhcludirg the 5th day of may, 1041; and
WHEREAS, proof of said. posting and. publication is evidenced by affi-
davits 0.11 file in the office of the City OlexE of said City; and
BRAS, no person interested or aciebting to said. work or improvement,
or to thm extent of the district of lands to be affected. or benotited by sain.
work and improvement and to be assessed to pay the costm and. exmensee thereof,
has made written. ohjectaor. to said work and improvement, and. no written objection.
to said. mark and improvement has been filed with said. City Cimxk, withln tex. days
after the expiration of' the time of the publication of cold notime, or
time, or at all; and
WHERRXS, the time prescribed, during 32 32 objections to sain work and.
improvement could be xade, has expired, and. this Council. hes acquired juris
tion to take action En said matter; and.
WHEREAS 3,32 321321 of the closing of said portions of said streets
has been duly and regularly continuen. from time to time until thix date; and
WHEREAS, public, interest ann convenience require the closing up of
said portions of said streets:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALANEDA
that public interest and convonixnce require the closing up of said portions of
said 32'-1 Street, Spruce Street and Cypress Street.
RESOLVED FURTHER, that the portions of Second. Street, Spruce Street
and Cypress Street, in the City of Alameda, County of Alameda, State of Ceaifornia,
hereinbefore more particularly described, be, and the same are hereby ordered
13) be, closed and abandoned.
The portions of said streets closed and abandoned as aforesaid.. are more
particularly shown in red upon a plat annexed. hereto and made a part hereof,
