Resolution 02729RESOLUTION NO. 2729 GRANTING TO THE UNITED STATES OF AMERICA A REVOCABLE PERMIT TO INSTALL AND MAINTAIN CERTAIN LIGHTS AND LIGHTING EQUIPMENT )TD TETCRARY SHELTER BUILDINGS ON TIDE LANDS OWNED BY THE CITY OF ALAMEDA. REEREAE, the United 3tates of America, hereinafter designated as Permit- tee, through duly authorized officers of the United States Army, has rode appli- cation to the City of Alameda, hereinafter designated as 'Permitter, for permission to install and maintain certain lights and lighting equipment and temporary shelter buildings on tide lands owned by the City of Alameda; and WHEREAS, such installation and maintenance will in no way interfere witl the activities of the City of Alameda and is deemed to be mutually beneficial to the parties L1-rote NOW, THEREFORE, SE IT RESOLVED BY THE COUNCIL OF MBE CITY 07 ALAMEDA as follows: The City of Alameda hereby grants permission to the United States of America to install and maintain lights and lighting eouipment and temporary shel- ter buildings on tide lands owned by the City and adjoining the Naval Air Station at a point at the extreme and of the Alameda Mole and near the old turn table pit. This permit is granted subject to the following provisions and conditions: (1) The privilege granted. herein shall be limited solely and exclu- sively to the purposes aforesaid. (2) Except as hereinbefore provided, the Permittee shall not place ripen the property covered by this permit any building or ether structure without prior approval of the Permittor. (3) The Permittee shall not assign this peinit, or any part thereof, without the written consent of the Permitter first obtained. (4) In the event that death or injury occurs to any person or loss, destruction or damage occurs to any property in connection with the construc- tion, maintenance, repair, or use of said facilities occasioned in whole or in part by any acts or omissions on the part of the officers, agents, employees or servants of the Permittee, the Permittee agrees to submit to the Congress of the United States a statement of the facts in regard thereto and to make -appropriate recommendations with respect to indemnifyihg and saving harmless the Permittor in whole or in part as the circurastances warrant. (5) The duration of this permit shall be indeterminate, but revocable without compensation at any time at the option and discretion of the Permitter. (6) The Permittee is net to be considered as acquiring hereunder any permanent interest of any nature whatever in the lands of OT subject to the jurisdiction cf the City of Alameda. (7) It is understood between the parties hereto that the title to the facilities installed under the provisions of this permit shall remain in the Permittee. (8) Upon the termination of this permit, the Permittee, at its sole expense, and within a reasonable time after receipt of notice thereof, shall remove its facilities and restore the Fermittor's land. as nearly as practicable to its original condition, if so requested by the Permitter. (9) No Member of or Delegate to Congress or Resident Commissioner shall be admitted to any share or part of this permit, or to any benefit to arise therefrom. Nething, however, herein contained shall be construed to extend to any incorporated company, if the permit be for the general benefit of ouch corporation or company. * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled en the 17th day of March, 1942, by the following vote, 80 wit: AYES: Councilmen Howe, Jones and President Godfrey, (;).
