Resolution 02772RESOLUTIDN NO 2772 GRANTMO PERMISSION TO THE UNITED STATES TO ENTER CERTAIN LANDS BELONGING TO THE CITY OE ALAMEDA AND TO CallENCE CONSTRBCTION THEREOF. WHEREAS, the Navy Department of the United. States is desirous of acquir- ing certain lands hereinafter designated, ovned by the City of Alameda, for the purpose of constructing thereon a national defense project; and WHEREAS, the United States, pursuant to law, may acquire such lands by purchase of condemnation; and WHEREAS, the United States, pending institution of condemnatien proceed- ings, is desirous of taking immediate possession of said lands for the purpose cf commencing construction of said projebt; THER12ORE, BB IT RESOLVED DY THE COUNCIL OF THE CITY CY ALAMEDA that the City of Alameda hereby grants unto the United States of America, the Navy Department thereof, and its representatives, contractors or agents, license and permission to enter into and upon the lands owned by the City of Alameda, located in the City of Alameda, County of Alameda, State of California, consist- i0.1 of approximately 21 acres and designated as parcel "2" on the map marked "Exhibit A" hereto attached and made a nart hereof, and to commence and pursue the construction of the project fur which such lands are to be acquired, in what- soever manner the Navy Department shall deem advisable, and in general to do and perform anything thereon which the United States could perfonm were it the owner thereof. BE IT FURTHER RESOLVED that the City of Alameda expressly agrees that if condemnation proceedings for such lands are instituted by the United Stet, the City shall net, in such proceedings, ask for or accept any compensatibh for any improvements made by the Intel States pursuant to ibis permit. HE IT FURTHER HIEOLVED that this license and permit shall be irrevocable, for a period of 90 days, beginning on July 7, 1942, and if condemnation proceed- ings are instituted by the United States within such 90 day period, until such tine thereafter as such proceedings are finally concluded or title to such land vested in the GovernmentT RESOLVED, FURTHER, that this license and permit is granted to and ac- cented by the United States with the specific understanding and. on condition that the City of Alameda reserves to itself all rights available to the City of Ala- meda in condemnation or other proceedings relating to the acquisition of such lands by the United States, including the right to receive just compensation for the taking of such lands. * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 7th day of July, 1942, by the following vote, to wit: AYES: Councilmen Sranscheid, Howe, Jones and Vice Preside, Maurer.
