Resolution 02824RESOLUTION NO. 2824 GRANTING PERMIT TO ALAMEDA BELT LINE TO CONSTRUCT, MAINTAIN AND OPERATE A RAILROAD SPUR TRACK ACROSS GRAND STREET 11, THE CITY OF ALANEDA. BL IT RESOLVED BY THE COUNCIL OF IRO CITY OF ALAMEDA that a permit be, and is hereby, granted to Alameda Belt Line, a corporation, its successors and assignr, to construct, reconstruct and maintain a single railroad spur track, and to operate locomotives, trains or cars thereon, with. steam motive power, on and across Grand Street in the City of Alameda, the center line of which spur track is described as follows: Beginning at a point OD the center line of an existing track No. 102, said point being a distance of 93,00 feet northerly from the northern line of Eagle Avenue and a dis- tance of 90.03 feet westerly from the western line of Grand Street; theace, easterly on the arc of a curve to the left having a radius of 237.94 feet a distance of 91.10 feet to the point of intersection of the western. line of Grand Street, said point being a distance of 107,43 feet northerly from the northwesterly corner of Eagle Avenue and Grand Street; thence northeasterly on the are of a curve to the left baying a radius of 287.94 feet, a distance of 89.87 feet across Grand Street to an intersection with the eastern line of Grand Street, said point being a distance of 148.56 feet northerly from the northeastern corner of Eagle Avenue and Grand. Street. This permit is granted on and subject to the following terms and conditions: 1. That said spur track shall be used for tp transportatiou of freight only. 2. That said spur track shall he constructed and maintained level with the ground, and that ail construction, operation end maintenance work shall be performed without coat or expense to the City of Alameda. 3. That all switch movements 07O" such spur track: shall be so con- ducted as not to block longer than is necessary for ordinary switching opera- tions the streets which are crossed by such spur track, 4. That this permit shall be indeterminate and shall be revocable without compensation at any time at the option of the Council of the City of Alameda. 5. That on revocation of this permit the Permittee shall, at its own cost and expense, forthwith remove said spur track and repave, macadamize or otherwise restore the portions of the street damaged or disturbed by such removal, using the same kind of material and construction as shall be used by the City of Alameda upon the portion of the street adjacent to said spur track. In the event that Perrittee shall neglect or refuse to so remove such spur track or to repair and restore said street es hereinbefore provided, the City of Alameda may cause such spur track to be removed and the work of repairing and restoring' said street to be done, and Permittee shall thereupon. be obligated to pay to the City the cost of such removal and of such repair and restoration. * * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in adjourned regular meeting assembled on the 12th day of January, 1943, by the following vote, to wit: AYES: Councilmen Branscheld, Howe, Jones, Maurer and President Godfrey, (5).
