AUENONdEING EXECUTION OF CONTRACT WITH ALAMEDA CITY
GARBAGE ASSOCIATION FOR THE COLLECTION AND REMOVAL
CF REFUSE AXE GARBAGE.
WHEREAS, it is necessary and in the public interest that provision be
mode for the collection, removal and disposal of refuse and garbage precluded in
the City of Alameda, and
WHEREAS, the Alameda City Garbage Association, a co-partnership, has
offered to enter into a contract with the City of Alameda for Inc collection,
removal and disposal of refuse and garbage in said city for a period of 10 years
from March 1,19430 and to pay the city for said privilege the sum of 1,800.00
per year, payable in eghal monthly installments of 150.0C in advance on the
first day of each and every month during the term of said contract; and
WHEREAS, a form cf contract for such collection, removal and disoosal
of refuse and garbage, containing the covenants and agreements to be stipulated
and agreed upon by and between Inc City of Alameda and the several co-partners
constituting said. co-partnership has been prepared and submitted to this Council
at its regular meeting held January 19, 1943, and has been filed with the City
Clerk of said city' and marked "Filed Jan. 19, 1943, Lorene R. Beatie, City Clerk",
and by reference is incorporated herein and made a part hereof;
NOW, THEREFORE, 91 IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAHEDA
that the form of contract to be entered into between the City of Alameda and
Alameda City Garbage Association, hareinabove referred to, and the terms, agree-
ments and provisions thereof be, and the same are hereby, approved.
RESOLVED, FURTHER, that the City of Alameda hereby grants to said
Alameda City Garbage Association the exclusive right and privilege to collect
and dispose of all refuse and. garbage in the City of Alameda for a period of 10
years from March 1, 1943, subject to and upon all of the terms and conditions
set forth in the aofresaid form of contract.
RESOLVED, FURTHER, that the Mayor of the City- of Alameda is hereby
authorized and directed to execute and the City Clerk to attest, on behalf of
the City of Alameda, a contract substantially in the form and containing the
covenants, agreements and provisions set forth in tree aforesaid form of ccrtract,
the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 19th day of January, 1943, by the following
vote, to wit:
AYES: Councilmen Branscheid, Jones, Maurer and President Cod
NOES: None,
ABSENT: Councilman Howe, (1).
