AUTHORIZING THE EXECUTION OF A STIPULATION FOR JUDGMENT
RESERVING CERTAIN EASEMENTS TO THE CITY OF ALAMEDA IN
LANDS SUBJECT OF CONDEMNATION PROCEEDINGS.
WHEREAS, the City of Alameda has been served as a Defendant in an
action to condemn certain lands in said City of Alameda., which action is now
pending in the District Court of the United States in and for the Northern
District of California, Southern Division, entitled therein., "United States
of America, Plaintiff, vs. 12.63 acres of land, more or less, situated in the
City of Alameda, Alameda County, California, PACIFIC STATES OIL CO,, et al„
Defendants", No. 22166-W; and
WHEREAS, the City of Alameda was the owner of certain easements and
rights of way across said land, more fully described in the form of Stipulation
attached hereto and made a part hereof by reference; . and
WHEREAS, the United State a of America has determined that it will
be of the greatest public benefit and the least private injury if said lands
be taken subject to said easements and rights of way, and said city wishes to
reserve said easements;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNOII OF TIE. CITY OF
ALAMEDA as follows:
That the City of Alameda agrees that the aforesaid easements that were
condemned in the above mentioned action shall be reserved to said city, and the
City Attorney for the City of Alameda is hereby authorized and directed to enter
into a Stipulation on behalf of said city, providing for entry in said action of
a Final Judgment which shall reserve the aforesaid easements to the City of Ala-
meda, said Stipulation to be substantially as set forth in the aforesaid form of
Stipulation.

1, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 17th day of August, 1943, by the following
vote, to wit:
AYES: Councilmen Branscheid, Howe, Jones, Osborn and President
Godfrey, (5).
NOES: None.
ABSENT: None,
