RESOLUTION NO. 2909
AUTHORIZING THE EXECUTION AND FILING OF .A DISaLAIVER
CONDEMNATION PROCEEDINGS.
WHEREAS, the City of Alameda has been served as a Defendant in an action
to condemn certain lands In the County of Alameda, which action is now pending in
the District Court of the United States in and for the Northern District of Cali-
fornia Southern Division, entitled therein, "United States of America, Plaintiff
vs. 12.63 acres of land, more or less, situated in the City of Alameda, Alameda
County, California, PACIFIC STATES OIL CO., et al., Defendants," No. 22166-W; and
WHEREAS, possession of the lands subject of said action was taken ty the
United States on the 18th day of April, 1943, and since said day the United States
has been in posSession of said lands; and
WHEREAS, it appears that there are no existing liens for taxes against
the lands subject of said action and that the City of Alameda has no interest in
the lands subject of said action, as described in the Complaint on file in said
action, except certain sewer easements and rights of way more particularly de-
scribed in the stipulation to be entered into in said action by the United States
of America, Pacific States Oil Co. and the City of Alameda, pursuant to authoriza-
tion contained in Resolution No. 2908, adonted by the Council August 17, 1943;
NOW, THEREFORE, BE IT RESOLVED that said City of Alameda has and makes
no claim to any title or interest in or to said lands subject of said action, or
any compensation which may hereafter be awarded for the taking thereof, except
the sewer easements and rights of way to be reserved to said city pursuant to
said Stipulation and the City Attorney is hereby directed and authorized to file,
on behalf of the City of Alameda, an appropriate Disclaimer in the above entitled
action.
I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 17th day of August, 19430 by the following
vote,- to wit:
AYES: Councilmen Branscheid, Howe, Jones, Osborn and President
Godfrey, (5).
NOES: None,
ABSENT: None.
