AUTHORIZING EXECUTION AND FILING OF STIPULATION FOR
FINAL JUDGMENT AND ORDER DIRECTING PAYMENT OF MONEY
IN' UNITED STATES vs. 69.448 ACRES, ETC., CITY OF
ALAMEDA, ET AL.
WHEREAS, the United States of America heretofore instituted condemna-
tion proceedings in eminent domain against certain parcels of land in the City
of Alameda, by filing an action in the District Court of the United. States for
the Northern District of California, Southern Division, No. 22463-8, entitled
United States of America, Plaintiff, vs. 69.448 acres of land, more or less, in
the City of Alameda, County of Alameda, State of California, City of Alameda,
et al., Defendants, said parcels being more particularly described in the Declara-
tion of Taking, the Complaint and the Judgment in said action, and title to said
parcels has now vested in the United States of America; and
WHEREAS, the City of Alameda is the owner of the said real property;
and
WHEREAS, by Resolution No. 2855, adopted May 18, 1943, this Council
authorized the execution of an offer by the City of Alameda to the United States
of America wherein the City of Alameda agreed to accept the sum of $125,000.00,
without interest, as full and just compensation for the taking of the property
subject of said action and any damages resulting therefrom, on condition that
the final judgment in condemnation in said action reserve to the City of Alameda
certain rights and easements, which rights and easements are more particularly
described in the form of Offer to Accept set forth in said resolution; and
WHEREAS, said Offer to Accept was duly executed by the City of Alameda
and the terms thereof have been accepted by the United States of America;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAMEDA
that H. Albert George, the City Attorney of the City of Alameda, is hereby
authorized and empowered to execute and file in said action, for and on behalf
of the City of Alameda, an appropriate stipulation or stipulations with the
United States of America, authorizing the making in said action of an order of
the court directing the payment of the sum of $125,000.00, without interest, to
the City of Alameda and providing for the entry in said action of a final judg-
ment of condemnation condemning the lands subject of said action and reserving
to the City of Alameda the rights and easements particularly described in said
Offer to Accept.

I, the undersigned, hereby certify that the foregoing Resolution was
duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 16th day of November, 1943, by the following
vote, to wit:
AYES: Councilmen Branscheid, Howe, Jones, Osborn and President
Godfrey, (5),
NOES: None,
ABSENT: None.
