Resolution 02966RESOLUTION NO. 2966 ACCEPTANCE AND CONSENT TO RECORDATION OF DEED FROM THE REGENTS OF THE UNIVERSITY OF CALIFORNIA TC THE CITY OF ALAMEDA. WHEREAS, the Council of the City of Alameda, by Resolution No. 2965, adopted April 18, 1944, authorized the acquisition by the City of Alameda for street and highway purposes of that certain real property situated in the City of Alameda, County of Alameda, State of California, more particularly described as follows: PORTION of Tract 39, es said tract is shown on the "Map of the Alameda Marsh Lands as partitioned among the owners thereof in the suit numbered 8923, and entitled Pacific Improvement Company, plaintiff, vs. James A. Waymire, et al., defendants, Superior Court of Alameda County, State of Cali- fornia, 1900", filed July 30, 1900, in book 25 of Mans at pages 74 to 78, inclusive, in the office of the County Re- corder of Alameda County, described as follows: BEGINNING AT A point on the Eastern line of Tract 32, as said tract is shown on aaid map, distant thereon North 5* 56' West 2210.42 feet from the Southeastern corner of said Tract 32; and running thence South 89* 10' West 316.48 feet to a point on the Western line of Webster Street as widened by deed by The Regents of the University of Califor- nia to City of Alameda, dated May 31, 1928, recorded June 5, 1928, in book 1867 of Official Records of Alameda County, at page 266, said point being the true point of commencement; thence South 89* 10' West 42 feet to a point; thence North 3* 43' 27" East 352.37 feet to a point; thence North 7* 08' 11" East 100.97 feet, more or less, to a point on said Western line of Webster Street; thence along said Western line of Webster Street the following courses and distances; South 0* 50' East 100 feet to a point, South 1* 47 17" East 150,02 feet to a point, and South 0* 50' East 201.26 feet to the true point of commencement; and WHEREAS, The Regents of the University of California, a corporation, has executed a deed of grant, dated April 13, 1944, conveying to said City of Alameda the real property hereinbefore described subject to the reversion of title under certain contingencies, as specified in said conveyance; NOW, THEREFORE, BE IT RESOLVED BY TEE COUNCIL CF THE CITY OF ALAMEDA that the aforementioned deed be, and the same is hereby, accepted on behalf of the City of Alameda, and said City Council, acting for and in behalf of said City, hereby consents to the recordation of said indenture and orders this reso- lution to be attached thereto as required by Section 1158 of the Civil Code of the State of California. * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 18th day of April, 1944, by the following vote, to wit: AYES: Councilmen Branscheid, Howe, Jones, Osborn and President Godfrey, (5).
