Resolution 02982RESOLUTiON NO. 2952 GRAN1ING PERMIT TO ALAMEDA BELT LINE TO CONSTRUCT, MAINTAIN AND OPERATE A RAILROAD SPUR TRACK ACROSS ATLANTIC AVEM IN THE CITY OF ALAMEDA. BE IT RESOLVED BY THE COUNCIL OF THE CITY 05 ALAMEDA that a permit be, and is hereby, granted to Alameda Belt Line, a corporation, its successors and assigns, to construct, reconstruct and maintain a single railroad spur track, and to operate locomotives, trains or car thereon, with steam motive power, on and across Atlantic Avenue in the City of Alameda, the center line of Which spur track is described as follows: Beginning at the point of intersection of the center line of the proposed track with the northern line of Atlantic Avenue, said point of intersection being 132.53 feet easterly along the northern line of Atlantic Avenue from an intersection ttereof with the east- ern line of Main Street; thence southeasterly across Atlantic Ave- nue on a curve to the left having a radius of 262.04 feet a dis- tance of 138.43 feet to an intersection with the southern line of Atlantic, said point of intersection being 232.54 feet easterly along the southern line of Atlnatic Avenue from an intersection thereof with the eastern line of Main Street. This permit is granted an and sulmject to the following terms and conditions: 1. That said spur track shell be used for the transportation of freignt only 2. That said spur track shall be constructed. and maintained level with the ground, and that all construction, operation and maintenance work shall be performed withaut cost or expense to the City of Alameda. 3. That ail switch movements over such spur track shall be 80 con- ducted as not to block longer than is necessary for ordinary switching, opera- tions the streets which are crossed by such spur track. 4. That this permit shall be indeterminate and shall be revocable without, compensation at any time at the option of the Council of the City of Alameda. 5. That on revocation of this permit the Permittee shall, at its own cost and expense, forthwith remove said SOUT track and. repave, macadamize or otherwise restore the portions of the street damaged or disturbed by such re- moval, using the same kind of material and construction as shall be used by the City of Alameda upon the portions of the street adjacent to said spur track. In the event that Permittee shall neglect or refuse to so remove such spur track or to repair and restore said street as hereinbefore provided, the City of Alameda may cause such spur track to be removed . and the work of repairing and restoring said street to be done, and the Permittee shall thereupon be obligated to pay to the City the cost of such removal and of such repair and restoration. $47 ¥ * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 17th day of May, 1944, by the following vote, to wit: AYES; Councilmen Branscheid, Howe, oica, Osborn and President Godfrey, (5).
