RESOLUTION NO. 3057
RESOLUTION AUTHORIZING ZIEGETION 05 SUPPLEMENTAL AGREEMENT
WITH THE uTITaD STATES OF A$aRICA FOR Rranvs, IN LIEU OF
RESTORATION' OF PREMISES COVERED BY LEASTE OF JULY I, 1E42
LEASING PORTIONS OF ALAMEDA MUNICIPAL GOLF COURSE.
MSPEREAS: Pursuant to Ordinance No. 8(.5, New Series, the City of Alameda
(hereinafter called the City) entered into a lease with the United States of America
(hereinafter called the Government) covering lands situated in this city mnd being
a portion of the Alameda Municipal Golf Course, which lease bears date of july 1,
iS42 and is designated in the records of the War Department of the Government as
Lease No. W r'- '0;
Pursuant to Ordinance No. 838, 00 (03(03', a supplemental agreement, dated
Tune 50, 1943, was executed between the City and the Covesnment to dispenae witil .
notice of renbwal;
Pursuant to Ordinance No. 844, New Series, a further supplemental. agree-
mbnt, dated October 31, 1943, was executed between. tne City and the Government to
include additional land described therein;
Heretofore the Government game notice to the City of its intention not
to renew beyond, and to terminate said lease ab of, Dune 30, 1344;
Prier to the extdration. of the term of said lease the City gave the
Government notice in accordance with Paragraph 8 of said lease reqtesting the
Government to restore said premises in accordance with the terms of said lease;
The Government proposes to 1' 30:. a settlement in lieu of performance
by the Government of the 2011 10.. required by said lease and. to stay the City
the sum of $2,633.(66 in consideration of the release and discharge of the Govern-
ment, its officers, agents mnd employees from any and all manner of actions, lia-
bility' amt claims for the restoration of staid premises, or arising out of said
lease and occupancy of said premises by the Governmentp and.
WHEREAS, a form 0 supplemental agreement for payment in lieu of res-
toration of premises, containing the covenants and agreements to be stipulated
an n. agreed nnon between the City and the Government 41) payment of a stipulated
sum in lieu of restoration. by the Government, has been submitted to this Outman
o its regular meeting held November 8, 1944, and the Council has read said agree-
ment and in familiar with the contents thereof;
NOM, TRERZFORE, BE IT RESOLVED BY THE °OUNCES OF THE CITY OF RIAD:MA
that the City accept payment of the 31111 of $2,633.66 in lieu of restoration of
the premises covered by said lease; and that Y. C. Godfrey, Mayor of the City of
Wlameda be, and. he is hereby, auXhorized to execute on behalf of the City a sup-
plemental agreement substantially in the form and containing tne terms, covenants,
agreements and provisions set forth in tho aforesain form of supplemental agree-
ment inst hereinaboya referred to.
