AUTHORIZING FILING OF DISCLAIMER IN EMINENT DOMAIN
ACTION INSTITUTED BY THE UNITED STATES OF AMERICA,
WHEREAS, it appears that the United States of America has instituted
proceedings in the District Court of the United States in and for the Southern
Division of the Northern District of California, entitled, "United States of
America, Plaintiff, vs. 0.336 Acre of land, more or less, situate in the City
of Alameda, County of Alameda, State of California, County of Alameda, et al.,
Defendants", No. 23431-R, to condemn certain land in the City of Alameda more
particularly described as follows:
Portion of Tract 35, as said tract is shown on the
Map of Alameda Marsh Lands" filed Tuly 3, 1900 in Book
25 of Maus at pages 74 to 78 Inclusive in 'the office of
the County Recorder of Alameda County, described as follows:
Beginning at a point on the western line of Webster
Street 80 feet wide distant thereon north 0* 52' west 167.66
feet from the southeastern corner of said tract 35; and
running thence north 78* 52' 30" west 157.24 feet; thence
north 11* 07' 30" east 100 feet; thence south 78* 52' 30"
east 136 feet to said line of Webster Street, and thence
along the last named line south 0* 52 east 102,23 feet to
the point of beginning.
Containing 0.336 acre, more or less,
and the City of Alameda has been served as a party defendant in said action; and
WHEREAS, it appears that the City of Alameda has no claim or interest
in or to any of the lands described in the complaint in said action; and
WHEREAS, it appears that all taxes and assessments levied or assessed
against said property have been paid; and
WHEREAS, the United States of America has present possession of these
lands:
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY 08 ALAMEDA,
as follows:
That said City of Alameda has and makes no claim to any right, title,
or interest in or to said real property or any compensation which hereafter may
be awarded. for the taking thereof, and the City Attorney of said City is hereby
directed and authorized to file an appropriate disclaimer in the above-mentioned.

duly and regularly introduced and adopted by the Council of the City of Alameda
in regular meeting assembled on the 19th day of December, 1944, by the following
vote, to wit:

NOES: None.
ABSENT: None.
