AUTHORIZING TEE CITY ATTORNEY OF THE CITY OF ALAMEDA
TO FIEF STIPULATION' TN EMINENT DOMAIN ACTION INSTITUTED
TT 11 UNITED STATES CF AMERICA.
WHEREAS, In condemnation proceedings entitled "United States- of America,
Flaintiff, vs. 154.6 Acres of land, more or less, in the City of Alameda, County
of Alameda, State of California, Louis M. MaeDermat, at al., Defendants," No.
23109-1, in the District Court of the United States, in and for the Northern Dis-
trict of California, Southern Division, the United States cf Americo. seeks to con-
demn the parcel. of lane comprising approximately twenty-one ()1) acres situated in
the City of Alameda, County of Alameda, State of California, and in said action
has served the City of Alameda as a party defendant; and
WHEREAS, the City of Alameda is 01e owner ef that certain parcel of land
referred. to as Parcel Eo. 1D, and more particularly described as follows;
Poginning at the intersection of the northern line
of Lot 11 of Section. 10, Township 2 South, Range 4 West, with
the line of ordinary high. tide, as said .. it and tide lino are
shown upon the map entitled "Nap No. 2 of Salt Marsh and Tide
Lnds," certified copies of whic0 .. are on file in the office of
the Surveyor General of the State of California (now the office
of the State Lands ComFission) and in the office of the County
Recorder of the City and County of Dan Francisco; running
thence along said line of ordinary high. tide theztwo following
courses and distances; Worth 35* 30, West 232.78 feet, to Sta-
tion 503, and North 18* 45, West 263.32 feet to the southern
line of Lot 6, in said Section 10, thence running along the
southern. line of Rots 6, 7 and 8, in said Section. 10, South 72*
West 1346.40 feet to the most western corner of said Lot 8;
thence south 45* West. 1101,34 feet to the most western corner
of Lot. 16, in Section 9, in said Township 2, Range 4 West;
thence along the northern line of said Lot 16, and aiong the.
northern ;ine of Lots 9, 10 and 11, in. said Section 10 North
2* East 2424.84 feet to the point of beginning; and.

and udocent entered thereon, title to said lands was vested in fee simple in and
possession thereof was taken by the United 001tes of America; and
WHEREAS, the Council of the City of Alameda is satisfied that the sum
of ,”,330. deposited by the plaintiff ix the above entitled. action in the regis-
try of said Court, and estimated by plaintiff as being the just compensation. for
the taking of the land above described which belongs to the City of Alameda,
represents the fair market value of said land;
NOW THEREFORE, PE TT RESOLVED BY THE COTTNCIL OF THE CITY CF ALAMEDA
that the City Attorney of the City ef Alameda be, and he is hereby, authericzed
to enter into e stipulation on behalf of said City of Alameda in said action.,
consenting to a judgment of taking and condemnation of the land. owned by the City
of Alameda, and above described, by the plaintiff in said motion for public pur-
poses, ana providing for the payment to the City of Alameda of the sum of
without interest, for such taking, subject, however, to any existing public utili-
ty easements end the rights of the public to use the boundary roads.
