Resolution 03279194 RESOLUTION NO. 3279 CANCELLING CITY TAXES ON REAL PROPERTY ACQUIRED BY Ti E VETERANS WELFARE BOARD OF THE STATE OF CALIFORNIA. 7HEREAS, the City of Alameda heretofore assessed and levied taxes for general municipal purposes against a certain parcel of real property situated in the City of Alameda, County of Alameda, State of California, hereinafter more particularly referred to, which taxes were assessed and levied for the years and in the amount and to the persons hereinafter set forth, to wit: Taxes for 2nd installment 1945-46, in the amount of $16.61; assessed to Frank Burno, Jr. and Lena A. Bruno; On parcel beginning at a point on the Northwestern line of Pearl Street, distant thereon Northeasterly 160 feet from the point of intersection thereof with the Northeastern line of Otis Drive (formerly Bay island Avenue) as said street and avenue are shown on the map hereinafter re- ferred to; running thence Northeasterly along said line of pearl Street 40 feet to the Southwestern. line of Clay Street, as said street now exists; thence Northwesterly along said line of Clay Street 100 feet; thence South- westerly parallel with said line uf Pearl Street 40 feet; thence Southeasterly parallel with said line of Otis Drive 100 feet to the point of beginning. Being a portion of Block "G", as said block is shown on map entitled, "Plat of the Lewelling Division, Alameda", filed October 18, 1887, in Book 19 of Maps, page 67, in the office of the County Recorder of Alameda County; the parcel of land. nereinbefore referred to being particularly described in the verified petition of the veteranst Welfare Board of the State of California bearing the date of February 25, 1.946; and WHEREAS, it satisfactorily appearing to this Council from said verified petition on file with the Council of the City of Alameda, and this Council upon satisfactory proof thereof so finds, that after the time that said assessments and taxes became a lien en the said parcel of real property said parcel of real prop- erty was acquired and owned, and ever since has been and now is owned, by the Veterans, Welfare Board of the State of California, a public corporation, and be- cause of such public ownership is not subject to sale for delinquent taxes; and WHEREAS, the aforesaid taxes andeassessments levied on said parcel of land, in the amount hereinbefore set forth, are uncollected. and unpaid; NOW TFEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ALAI=A, the written consent of the City Attorney of the City of Alameda having been given heretofore us recuired by law, that the aforesaid uncollected taxes and assess- ments charged or levied by the City of Alameda for city purposes upon the afore- said parcel of real property, together with all penalties and costs thereon, be, . and the same are hereby, cancelled, and the Auditor and Tax Collector or other officer of the City of Alameda having the custody of the record thereof, are hereby authorized and directed to cancel such taxes and assessments so levied or charged, together with all penalties and costs thereon, and to make appropriate entries and record of such cancellation on their respective books; and PE IT FURTHER RESOLVED AND ORDERED that if the aforesaid parcel of real property has been sold to the City for non-payment of any of the aforesaid uncol- lected taxes, assessments and penalties or costs thereon hereinabove ordered to be cancelled, and a certificate of sale or deed therefor has been issued to the City, and the City has not disposed. of said property so sold, the officer having custody of the record thereof be, and he is hereby, directed to cancel. the certi- ficate or sale or deed so issued. BE IT FURTHER RESOLVED, anything in this resolution to the contrary notwithstanding, that this resolution and order shall not be construed as can- celling or authorizing the cancellation of any taxes or assessments levied or charged against any possessory interest in said parcel of real property or of any special assessment taxes levied against said parcel of real property by the City of Alameda pursuant to the provisions of the "Acquisition and. Improvement Act of 1925." * * * * * * * * * * the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 5th day of March, 1946, by the following vote, to wit: AYES: Councilmen Howe, Tones, Osborn, Sweeney and President Branscheid, (5).
