Resolution 03307RESOLUTION NO. 3307 AUTHORIZING CITY ATTORNEY TO SINN STIPULATION EXTENDING TIME WI= WHICH ACTION MUST BE BROLJBTIT TO TRIAL. WEEREAS, action No. 179210 has heretofore been commenced against Homer R. Dallas, City Tax Collector of the City of Alameda; F. J. Cron, City Tax Assessor for the City of Alameda; M. C. Godfrey, Mayor, W. 4. Eranscheid, Walter V. Howe, Sherwood Jones, Frank P. Osborn, Counoil of the City of Alameda; and City of Alameda, a municipal corporation, for recovery of taxes for the fiscal year beginning July 1, 1943, levied and assessed upon the General Engineering and Dry Dock Company's possessory interest in certain shipyard facilities located in the City of Alameda, County of Alameda, State of California, which said taxes were paid under protest; and WHEREAS, the General Engineering and Dry Dock Company, plaintiff in said action, has heretofore filed in said action a stipulation extending time within which said defendants may appear, plead, demur, answer, or make such motion as they or each of them may be advised, to plainfiff's complaint, to the end of the fifteenth day after the service of a notice, as provided in said stimulation; and WPaREAS, the Council of the City of Alameda deems it expedient to enter into a further stipulation in connection with the trial of said action. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF TEE CITY OF ALAMEDA that the City Attorney be, and he is hereby, authorized and directed to enter into a stipulation by and between the respective parties to said. action to the effect that the time within which General Engineering and Dry Dock Company, plaintiff therein, is required to bring said action to trial, under the provisions of Section 583 of the Code of Civil Procedure of the State of California, is ex- tended to May 30, 1949. * * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 21st day of May, 1946, by the following vote, to wit: AYES: Councilmen Howe, ,Ionos, Osborn, Sweeney and President Bransoheid, (5).
