Resolution 03319244 RESOLUTION NO. 3319 DECLARING PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OE CERTAIN LASDS FOR PUBLIC STREET AND IlIalLWAY PURPOSES. RESOLVED BY THE COUNCIL OF ESE CITY Jr ALAMEDA, and said Council hereby finds and determines that the public interest and necessity require the acquisi- tion by said City of Alameda for use by said City for public street and highway purposes, all of those certain lots, pieces or parcels of land situate, lying and being in said City of Alameda, CountTpf Alameda, State of California, and more particularly described as follows: PARCEL 1: Beginning at the point of intersection of the Southwestern line of Buena Vista. Avenue, with the Northwestern line of Everett Street, running thence adons said line of Buena Vista Avenue North 56* 52' West 63 feet to a point from which the center of a circle having a radius of 311.63 feet bears South 33* 081 West 311.63 feet distant; thence along the arc of said circle Southeasterly 46.12 feet to a point from which the center of said circle bears South 41* 76' 45" West 311.63 feet distant; thence along the are of a compound circle, having a radius of 20 feet, the center of which said circle bears South 41* 36' 45" West 20 feet distant Southeasterly, Southerly and Southwesterly, a distance of 28.46 feet to a point on the said Northwestern line cf Everett Street, and from which said point the center of the last mentioned. circle bears North 56* 521 West 20 feet distant; thence along said line of Everett Street North 33* 081 East 23.19 feet to the point of beginning. PARCEL Beginning at the point of intersection of the Northeastern line of Buena Vista Avenue with the Southeastern line of Everett Street; running thence along said line of Everett Street North 33* 05' East 86.42 feet to a point from which the center of a circle having a radius of 38 feet bears South 56* 52' East 38 feet distant; thence along the arc of said circle Southerly and Southeasterly a distance of 44.53 feet; thence taneent to the last mentioned arc, Sautn. 34', 007 30" East 69.14 feet; thence southeasterly along the arc of 0 circle deflecting to the left or Eastward, tangent to the last mentioned course, having a radius of 311.63 feet, a distance of 63.85 feet, more or lose, to the Northwestern line of the right of way of the Southern pacific Company; thence along the last mentiuhed line Southwesterly 6.52 feet, more or less, to the said Northeastern line of Buena Vista Avenue; thence along the last mentioned line North 56* 52' west 144,6 feet, more or less, to the point of beginning. RESOLVED, FURTHER, that the City Attorney be., and he is hereby directed to commence condemnation proceedings in eminent domain for the acquisitim of said lots, pieces or parcels of land, and that the Mayor be, and he is hereby, instructed, authorized and directed, for and on behalf of said City and its City council, to subscribe to and verify a complaint in the Superior Court of said Alameda County for the condemnation of said lots, pieces or parcels of land for public street and highway purposes, * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regular meeting assembled on the 5th day of June, 1946, by the following vote, to wit: AYES: Councilmen Howe, Jones, Osborn, Sweeney and President Branscheid, (5).
