Resolution 04962RESOLUTION NO. ;i962 ORDERING THE VACATION OF THAT PORTION OF VAN BUREN STREET LYING BETWEEN' COURT STREET AND MOUND STREET, IN THE CITY OF ALAMEDA WAS, the Council of the City of Alameda did, on. the 29th day of June, 1954, pass its Resolution cf intention No. 49,54, declaring its Intention. to order the vacation and closing of that certain portion of Van :Buren Street, in the City of Alameda, County of .Alameda, State of California, more particularly described in said Resolution of Intention R3 follow COMLENCING at the northeasterly corner of the intersection of Van Buren Street and Mound Street as such streets are located on the "Map of Town of Alameda and Adjacent Lands" surveyed by Horace A. Higley and recorded September 12, 1867, in dock 5 of Maps, at Page 16, in the Alameda County Recorder's Office, which point shall be the TRUE POINT OF BEGINNING; THENCE easterly along the northerly boundary line of Van Buren Street 235.08 foot to the west property llne of Court Street; TH12NCE southerly along the west property line of Court Street extended 60 feet to the south property line of Van Buren Street; THENCE westerly along the south property line of Van Buren Street 235.08 feet to the eastern property line of Mound Street; THENCE northerly alon7 Inc eastern property line of Mound Street extended 60 feet to the TRUE POINT OF REGINNINC; and WHEREAS, the portion of said Van Buren Street to be vacated and closed and the details of said vacation are more particularly shown upon that certain map bearing the legend "Mao of Town of Alameda and Adjacent Lands, Filed Sept. 12, 1867", which map was by said Resolution of Intention approved for the purpose of this proceeding and was ordered filed in the office of the City Clerk of the City of Alameda and marked "Filed Junb 29, 1954!', and. which map was in said resolution referred. to for further particulars as to the proposed vacation; and WHEREAS, the City Clerk of the City of Alameda caused said Resolution of Intention to be published in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said city anb the official newbe paper thereof; and WHEREAS, proof of saia . publication is evidenced by an affidavit of publi- cation now en file in the office of the City Clerk. of Said city; and. WHEREAS, proof of said posting. of such. notices is evidenced by the affi- davit of the person posting said. notices, which affidavit sets forth the facts regarding such posting ano . is now on file in the office of the City Clerk of said City; and '3' '10, the matter of said proposed vacation cane on regularly for hear- ing before the Council of the City of Alameda at this, its regular meeting, on the 20th day of July, 1.954, and at the time and place fixed in said Resolution. of intention, and at such heaning the said Council heard the evidence offered by all ID"" sons interested in. said street vacation, and a. full hearing thoreon 11 '303 been had and the matter submitted for determination; NOW THEREFORE, BE IT RESOLVED BY 111 COUNCIL 0 THE CITY OF ALAMEDA. that said Council hereby finds and determines, from all the evidence submitted, that the street and part thereof in said Resolution of Intention and hereinbefore more particularly described, is unnecessary for present and prospective public street pnrposes arb that public interest requires the vacation of said portion of said street. BE IT FURTHER RESOLVED that the portion of Van Buren Street in said.
