ACCEPTING. 1139909 391'9 IN SUBDIVISTION KNOWN AS TnACT
1210 AND RELEASING LIASILITY UN= SURITY BCHD
ITHEREAS, on the 9th day of April, 1953, Central Avenue. Land Development Co.,
a limited oartnenstlip, entered into a contract with the City of Alameda in connection
with the subdivision of Tract 1210; and.
WHEREAS, the Council of the CWay of Alamedn authorized the City Manager of
the City of Alameda to enter into a contract between the City of Alameda and sal.d.
Central Avenue Land Development Co., SitodAvidero, for the construction of the improve-
ments specifically shown on the "Tentative MR7 of Tract 1249"; and
901REAS, said Subdividers requested permission to postpone the improvements
proposed to be constructed in said Tract 1249 to a time subsequent to the acceptance
of the Final Nap of sai9 . subdivision; and
N7IEREAS, in consideration of said postponement, said Subdividers did agree
to, and did, file with the City of Alameda o. surety company bond in the penal sum of
$20,000.00, being the estimated cost of such improvements, and guaranteeing the faith-
ful performance of the terms a0 d. conditions of 8aid agreement, and also of the require-
ments contained. 1 Ordinance No. TOO, New Series; and
WHEREAS, said contract of April 9, 99' now been fully performed and
all of the provisions of said Ordinance No. 700$ NeN' Series, haveteen fully complied
with;
NIa7 =INTONE, BE IT RESOLVED BY THE COUNCIL OF THE CITY MP AITUHTDA that
sa,U. City does hereby accept the tract improvements referred to in said contract and
shown on the ISintative Map and. the Final Map of said Tract 12t9.
091 FURTHER RESOLVED that the Council of the City of Alameda does hereby
release said Subdividers, and their surety, from any further liability under said
520,000.00 surety bondi, filed with the City of Alameda, c',naranteein the faithful
performance of said contract.
I, the undersigned, hereby certify that the foregoing Resolution was duly
and regularly introduced and adopted by the Council cf the City o f Alameda. in regular
meeting assembleci . on the 7th day of December, 1954, by the followine, vote, to wit:
