Resolution 05823RESOLUTION NO 5623 DECLARING PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LANDS FOR RIGHT-OF-WAY PURPOSES, INCLUDING. STREET AND HIGHWAY, SANITARY SEWER AND STORM SEWER PURPOSES (TILDEN WAY) (FLEMING). RESOLVED BY THE COUNCIL OF THE CITY CF ALAMEDA, and the said Council hereby finds and determines that the public interest and necessity require the acquisi- tion by said City of Alameda for U90 by said City for right-of-way purposes, includ- ing public street and highway, sanitary and storm sewer purpcses, that certain lot, piece or parcel of land situate, lying and being in said City of Alameda,County of Alameda, State of California, and more particularly described as follows: Block No. 1 in Jenks and Mead's Homestead Tract, as reference to the plat on file in the Recorder's Office of the County of Alameda will more fully show; being a triangular piece of land bounded en the north by Buena Vista Avenue, on the west by Everett Street, and on the southeast by the Railroad right-of-way, and including the northern 25 feat of the Railroad right-of-way adjacent thereto. RESOLVED, FURTHER, that the City Attorney be, and he is hereby, directed to commence condemnation proceedings in eminent domain for the acquisition of said lot, piece or parcel of land, and that the Mayor be, and he is hereby, instructed, authorized and directed, for and on behalf of said City and its City Council, to subscribe to and verify a complaint, and to subscribe to any and all other neces- sary papers and documents in the Superior Court of said Alameda County for the con- demnation of said lot, piece or parcel of land for the purposes set out above. BE IT FURTHER RESOLVED that the City Attorney is hereby empowered to employ special legal counsel to aid in the prosecution of said condemnation pro- ceedings at all stages thereof. 0 * * * * * * * * * I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City of Alameda in regu- lar meeting assembled on the 15th day of July, 1956, by the following vote, to wit: AYES: Councilmen Collischonn, Freeman, Petersen, Schacht and President McCall, (5).
