Resolution 05870400 RESOLUTIION YO. 5870 RESOLUTION OF INTENTION TO ORDER THE VACATION o A PORTION OE PEARL STREET, IN THE CITY OF ALAMEDA RESOLVED DY THE COUNCIL CF THE CITY CF ALAMEDA that the public 1ntrest rec1ires, and said Council hereby declares its intention to order the vacation, clos- ing and abandonment of that certain portion of Pearl Street, in the City of Alameda, County cf Alameda, State of California, described as follows: That portion of Pearl Street beginning at a point on the northwestern line of Pearl Street distant thoraon South 3L* 21' 05" West 112.75 feet from the southwestern line of Otis Drive, 50 feet in width, formerly Bay Island Avenue, as said street and avenue are shown on Block 'H' of the Lewelling Division according to the map thereof filed October 18, 1887 in the office of the County Recorder of Alameda County and of record in Map Book 19, page 67; and running thence along said line of Pearl Street South 34* 21' 05" West 85.25 feet; thencs at right angles South 55* 38' 55" East 60 feet to the south.easterly line of Pearl Street; thence northeasterly alooR said southeasterly line of Pearl Street North 3d* 21, 05" East 85.25 feet; thence southwesterly, westerly and northerly along a tangent curve to the right having a radius of 30.00 feet, an arc distance of 94.2.5 feet to the point of beginning. RESOLVED, FURTHER, that said Council finds and determines that the public convenience and necessity require the reservation to the City of Alameda of a per- manent easement and right-of-way over and across a certain parcel of land situate in that portion of Pearl Street proposed to he vacated, for the purpose of con- structing, operating, maintaining, replacing, renewing and repairing thereon storm and sanitary sewers, or either of them, and said permanent easement and right-of-way for the aforesaid purposes is hereby reserved to the City of Alameda and excepted from the vacation of said portion of. Pearl Street, over and across the following described parcel of land: BEING a strip or parcel of land, 10.00 feet in width, situa te in the City of Alameda, County of Alameda, State of California, along the center line of Pearl Street extended across above described abandon- ment for the City of Alameda. Said easement shall provide to the City of Alameda all rights to enter upon the easement area for the purpose of constructing, maintaining, or repairing a sewer or sewers. Said easement shallwst the control of all improvements thereon with the City Engineer of the City of Alameda, and it shall be necessary for the owners of the land through which the easement exists to procure from the Office cf the City Engineer a permit or permits for any and all improvements to be constructed on the surface of the ground, RESOLVED, FURTHER, that the portion of Pearl. Street to be vacated and aban- donhd and the details of said vacation are more particularly shown upon that certain map known as Drawing 4770, Case 52, bearing the legend: "Closing of Portion of Pearl Street South of Otis Drive," which map is nereby approved for the purpose of this proceeding and is hereby ordered filed in the office 01 the City Clerk of the City of Alameda, and which map is hereby referred to for particulars es to the pro- posed vacation. RESOLVED, FURTHER, that the 6th day of January, 1959, at 7:30 o'clock p.m. of said day, in the COUNCIL CHAMBERS in the CITY HALL, at the northwest corner of Santa Clara Avenue and Oak Street, Alameda, California, be, and the same is hereby, fixed El5 the time and place for hearing by the Council of SRIA. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed. to cause this resolution to be published, in the manner prescribed by law for the publishing of ordinances of the City of Alameda, in the Alameda Times-Star, a daily newspaper of general circulation published and circulated in said City, and the official newspaper thereof. RESOLVED, FURTHER, that the City Clerk of the City of Alameda is hereby directed to post, or cause to be posted, conspicuously along the line of the street and parts of street proposed to be vacated, notices of such vacation, in the form and manner required by the legislative act hereinafter mentioned, RESOLVED, FURTHER, that in the herein proposed vacation of said street or portion of street aforementioned, the Council of the City of Alameda hereby elects to proceed under and in pursuance of the provisions of the Street Vacation Act of 1941 of the State of California (Chapter 250, Statutes of 1941), as amended. 101 I, the undersigned, hereby certify that the foregoing Resolution was duly and regularly introduced and adopted by the Council of the City Lf Alameda in regu- lar meeting assembled on the 2nd day of December, 195d, by the following vote, to wit: AYES: Councilmen Collischonn, Freeman, Schacht and Vice President Petersen, (4).
